Reciting:
(I) will of Francis, 7th Duke of Bedford, of 7th May 1861 devising all his real estate to Charles Romilly, George Russell and Thomas Henry, Baron Foley in trust for (ii) with power for (i) to sell
(II) death of Francis, 7th Duke of Bedford on 14th May 1861 and proof of his will and two codicils in PPR on 31st July 1861
(III) death of Thomas Henry, Baron Foley on 20th November 1869
(IV) death of William, 8th Duke of Bedford on 26th May 1872
(V) indenture of 9th October 1874 (1) Hastings, 9th Duke of Bedford; (2) Charles Romilly (3) George Russell (4) Samuel Whitbread appointing (4) instead of (3) as trustee of the will of 7th Duke of Bedford
(VI) (i), with the consent of (i), had agreed to convey (a) to (iii) for £778/2/6
