    Deed of Covenant Parties: (i) The Mayor, Aldermen and Burgesses of Bedford as local Board of Health; (ii) William, 8th Duke of Bedford; (iii) Thomas Henry, Baron Foley; Charles Romilly of Wilton Crescent, Belgrave Square [Middlesex], esquire; George Russell of Curzon Street, Mayfair [Middlesex] as trustees of the will of Francis, 7th Duke of Bedford Reciting: - R6/5/20/9/1; - it was agreed in R6/5/20/9/1 that (i) would enter into covenants Operative Part: - (i) covenanted as below regarding (a) in R6/5/20/9/1 of which a plan is included Covenants: 1. (i) will complete the embankment works abutting the forecourt and gardens of the Swan Hotel; 2. (i) would erect a substantial brick wall with an ornamental iron fence as approved by Henry Clutton, the Duke’s architect, on land of (iii) immediately adjacent to the embankment and be his property; 3. the present screen wall and gates of the hotel were to be preserved and (i) construct and ornamental fence, as approved by Clutton, to be property of (iii); 4. (i) would not encroach with the intended road from the embankment to the two bridge on the forecourt of the Swan Hotel and would use granite denter stones flush with the ground to indicate the limit of the right away; 5. (i) would not, without (iii)’s consent permit boat stairs adjacent to the Swan gardens of hotel buildings; 6. (i) would level that portion of the Swan gardens to form a level terrace; 7. the works carried out by (i) would not interfere with the Swan drainage and cause as little “annoyance and inconvenience” as possible to the tenant; 8. that water communication between the Swan gardens, yards and stables and the river should be continued and be “as abundant as at present”; 9. (i) would keep all works in good order except the walls on the property of (iii) which would be maintained by (iii).
