    George Burgess said: I am a Police Constable stationed at Luton. On Friday evening the 2nd September about 8pm the two prisoners were at the Luton Police Station concerned in a theft of potatoes and tarpaulins – they had a pony and cart with them and on searching the cart amongst other things I found the sack now produced full of kidney beans - on the following Monday the 5th September I charged the two prisoners at the Biggleswade Police Station with stealing one sack of kidney beans the property of Ebenezer Marshall from a field at Girtford Bridge - King pointed to Panter and said "Mr Panter carried them out of the field and put them in the cart - I did not steal them". Panter made no reply. I produce the sack and beans. Albert Feltwell said: I saw a labourer in the employ of Ebenezer Marshall of Girtford, Market Gardener. On Friday 2 September I was employed with Frederick Matthews gathering kidney beans for my master in Poplar Tree field near Girtford Bridge – we left the field at one o’clock for dinner – at the time there were 6 sacks full of kidney beans which we had gathered – on our return an hour afterwards I missed a sack of beans – the one produced is one of the 6 that were in the field – I know it by my master’s name and address being on it “E Marshall Manor Farm Sandy” I remember it was nearly a new sack. Ebenezer Marshall said: I am a Market Gardener at Girtford Sandy – the witness Albert Fretwell was in my employ on the 2nd September and was employed gathering kidney beans in Poplar Tree field near Girtford Bridge – the two bags now produced are my property and the beans are the same sort that were growing and being gathered in my field on the 2nd Sept. They are worth 3 shillings. statements of the accused: Panter: I have nothing to say. King: I am innocent. I refer to my previous statement.
