    George Burgess said: I am a Police Constable stationed at Luton. On Friday evening the 2nd September about 8pm the two prisoners were at the Luton Police Station concerned in a theft of potatoes – they had a pony and cart with them and on searching the cart amongst other things I found the two tarpaulins now produced – I said to the two prisoners “How do you account for having these two tarpaulins” Panter replied “We found them down the road there was another old chap going to pick them up and I said ‘Hold on old boy give us a chance’”. The following day in each others presence I charged them with stealing the two tarpaulins at Great Bramingham, they both replied “We did not steal them but told the Inspector about them last night” I was present the previous night when Panter told the Police Officer that they had found them – it was said in reply to a question as to how they became possessed of them. I produce the two tarpaulins. [King cross-examined] You both made the same remark inside the gates near the Cells in Luton [Panter cross-examined] You told the Inspector at Luton how you had come by them. John Cook said: I am a Farmer residing at Great Bramingham – the two tarpaulins now produced are my property and worth 10 shillings each. I saw them on the 2nd Sept at 3.30pm on my reaping machine. I had tied one of them then to the machine and it was so tied and I left the machine standing about 60 yards from the high road. I did not see them again until the afternoon of the 3rd Sept when they were shown to me by the Police. statements of the accused: Panter: I have nothing to say. King: I am innocent. I never stole them.
