Scope and Content
recites: 1) many years since constructed at their own cost partly on land of 1) and partly on land of 2) sidings and a carts approach road to accommodate Francis Pym and his farm servants as well as for Company and people authorised by them. ALSO put up two gates.
F Pym has leased brickworks to 3) who wants the sidings to be used for his traffic as well as F Pym’s.
Agreement of 13 July 1888 rescinded
1) will maintain the sidings; 2) will maintain the road. Sidings and gates remain absolute property of company.
1) right to use sidings AND road in event of damage, company will make up at additional cost. Clauses re rights of use of sidings and road by 2) and 3)
Power of 1) to alter or substitute siding on notice to 2) and 3)
Rent to be paid by 3) to 2) of £17..10s haulage on Railway sidings by company only but loaded and marshalled by 2) and 3).
2) and 3) to use 1)’s railway for all traffic of every kind to the works.
