Will of John Freshwater of Great Barford, 24 November 1736 bequeathed to his wife Jane Freshwater
... the house and lands in Great Barford for her life, and then to John Freshwater (the father of i))
... the house and close in occupation of Robert Green for her life, and then to John Freshwater (the father of i)
whereas: land and houses passed to Jane Freshwater on death of John Freshwater of Great Barford
whereas: Jane Freshwater proved the above will 14 January 1737 in court of Bishop of Bedford
whereas: Jane Freshwater died 1745
whereas: John Freshwater (the father) died 1774 without making will, therefore leaving i) in receipt of rents of premises
whereas: by devise by mortgage 2 November 1826 between i) and ii), that i) indebted to ii) for £300, would devise the houses and lands above to ii) to secure payment to ii)
It is witnessed, in consideration of £300 due from i) to ii) and in consideration of 5s paid by ii) to i)
i) granted to ii) the houses above for 99 years for yearly rent of a peppercorn (if demanded)
subject to condition for redemption of houses on payment by i) of £300 with interest
whereas: now due to ii) all £300 and interest.
whereas: ii) requested i) to pay him; i) is unable; so ii) requested iii) to lend £300, in return for having the same with interest secured by a mortgage of houses and lands above.
Agreed that term of 99 years be assigned to iv) in trust for iii) to attend the inheritance
In pursuance of payment by iii) to ii) acknowledged by ii) to acquit iii) and i) of money owed
i) confirms iii) in possession by lease of 15 November 1827 for one year
... all that land in Great Barford, 3 acres, in occupation of i)
... and house in Great Barford in occupation of John Freshwater the Younger (tenant-at-will for £10 per annum)
... and house in Great Barford in occupation of Thomas Chapman (tenant-at-will for £3 per annum)
... and house in Great Barford in occupation of Sarah Gurnott (tenant-at-will for £1..10s per annum)
... and house in Great Barford in occupation of William Peck (tenant-at-will for £3 per annum)
... and house in Great Barford in occupation of Elizabeth Rolls (tenant-at-will for £1..10s per annum)
... and 2 cottages in Great Barford in occupation of Thomas Field and William Forster (tenant-at-will for £8 per annum)

... and all deeds, evidences and writings about houses
To have and to hold: above mentioned property. release to iii), discharged from proviso of redemption in lease of 2 November 1826, but subject to proviso agreed between iii) and i) that on default of payment of £300 and interest, iii) can enter above mentioned property.
In consideration of £300 due in mortgage and paid to ii) and in consideration of 10s paid by iii) to ii) (acknowledged receipt) ii) bargains and sell to iv) all property above mentioned
To have and to hold: property for 99 years by iv), interest for iii) with rights of freehold reversion and inheritance
Provided
as agreed by i) and iii), that if i) pays £300 and interest at 5% per annum at/upon 16 November 1828 then iii) at request of i) will give back houses as recovery
£300 being secured by a Bond of 16 November 1827 between i) and iii), in penal sum of £600 for payment on 16 November 1828 of £300 plus interest.
Provided that until default made of payment of £300 the property be lawful for i) to occupy and use, taking rents and issues.
