    Samuel Clothier of Markyate Street – he is foreman to James Colquhoun Esq. On Saturday 8 June about 7pmhe was standing in Markyate Street when he saw Flitton with a donkey and cart loaded with wood. He suspected Flitton had stolen it from his employer’s wood called Deadmondsey Wood. He asked Flitton where he got it from. Flitton said he bought it in Deadmondsey Wood. He told Flitton he would search his cart and sent for PC Robert Batchelor. They searched the cart and found 6 pieces of oak with his master’s mark on them. Flitton said he bought the wood from Thomas Byrchmore. He gave Flitton into custody. Robert Batchelor of Markyate Street, police constable – on Saturday 8 June about 7pm Mr Clothier sent for him. He searched Flitton’s cart and they found 6 pieces of oak, now produced. Thomas Byrchmore of Caddington – on 8 June he was at work in Deadmondsey Wood in the parish of Whipsnade about 5pm. He saw Flitton with a donkey and cart close to where he was working. He was working for Mr Colquhoun at some oak tops. Mr Clothier the foreman ordered him to go to Markyate Streeet. He left Flitton in the wood with his donkey and cart. He did not sell any of the wood to Flitton.
