Scope and Content
Parties:
(i) Letitia Carter, wife of Charles Carter of Biggleswade, George Wagg of Biggleswade, Accountant [the Mortgagors], executors of Ellis Piggott Jeakings, late of Biggleswade, Gentleman.
(ii) Mary Eva Jefferson of Molyneux Park Mansions, Tunbridge Wells[Kent], Spinster [the Mortgagee].
Reciting
Ellis Piggott Jeakings by his Will of 28 July 1911 appointed (i) as his trustees.
Ellis Piggott Jeakings made a Codicil to his Will on 14 November 1911 which did not affect the trustees.
Ellis Piggott Jeakings died 23 November 1911 and his will and codicil were proved by his executors in the Principal Probate Registry.
Ellis Piggott Jeakings was seised of the hereditaments described as (a ) and (b) in the following schedule.
There is a deficiency in the personal estate of Ellis Piggott Jeakings and in order to meet such deficiency and for purposes connected with the administration of his estate (i) require £800 which (ii) has agreed to lend them upon having the repayment thereof with interest.
Operative part
In consideration of £800 paid to (i) by (ii) the receipt of which (i) hereby acknowledges, (i) as the trustees of Ellis Piggott Jeakings convey to (ii) all the hereditaments described in the following schedule in fee simple provided that (i) on the 1st February 1913 pay (ii) £800 with interest at the rate of £4 % per annum computed from the date of this Indenture and in such case the said hereditaments shall at the request and cost of (i) be reconveyed to them.
If £800 should not be paid on 1st February 1913 the hereditaments shall be charged with the payment to (ii) of interest at the stated rate by equal half yearly payments on the 1st of August and the 1st of February until the principal sum is fully paid. The amount of the insurance of the buildings which may be effected by (ii) shall not exceed £900.
(i)are not personally liable for the payment of the principal sum and interest.
Schedule
(a)Two messuages or dwelling houses, gardens and premises situate in Drove Road, Biggleswade having frontage to the road of 40’, bounded on the N. by property of [ ] on the East by property of Thomas Walker, on the S. by property of Charles Edward Huckle and on the W. by Drove Road.
(b)Six messuages or dwelling houses with gardens and premises situate in Sun Street, Biggleswade known as Nos. 1 – 6 St John’s Terrace bounded on the E by property of Charles Carter, on the N. by property of Ellis Piggott Jeakings and on the W. by property of [ ] and on the S. by the High Road.
