Susan Smart of Park Square, Luton, wife of John Smart, bootmaker – on a Saturday evening around the end of March 1878 Morton came to her shop and asked to take 2 pairs of children’s boots until Monday morning when she would pay for the pair she kept and return the other pair. She said her name was Allen and she lived at Woodside. She believed Morton and allowed her to take the shoes. Morton never returned and she had not seen her again until she saw her in custody. Charles Haines, police constable for the Borough of Luton – he knows Sarah Morton who lives at Markyate Street. On Monday 17 June she was in custody and he charged her with having two pairs for boots from Mrs Smart’s by false pretences. She said she did have them but lost them going home.
