    Conveyance. (1) William Henry Cox, Saint Katherine, Guildford, Surrey (mortgagor) (2) John Everitt, late of Luton, but now of Alexandra Park, Hornsey, Middlesex, Esq. (vendor) (3) Thomas Poulter, 30, George St. Luton, collector of rates and assessments (purchaser) Whereas: by a mortgage of 26 November 1860 William Henry Cox advanced £5000 to John Everitt in respect of the close of ground, orchard, hereditaments and premises of which the property intended to be conveyed forms part. And whereas: by indenture of further charge of 4 June 1862 William Henry Cox paid John Everitt £500, and John Everitt assigned the close of ground to him. And whereas: the principal sum of £5000 only is owing on the mortgage, the interest having been paid. And whereas: since the last recited indentures John Everitt has constructed a new road and erected several messuages and buildings on part of the said land. And whereas: Thomas Poulter has contracted with John Everitt for the absolute purchase of the land and premises for £120, William Henry Cox being satisfied with the remaining mortgage securities. And whereas: one of the conditions of the said contract was that Thomas Poulter should enter into a covenant not to erect any building on the premises containing less than three stories, with the other restrictions in the covenants hereinafter contained. Witnesseth: in consideration of £120 paid by Thomas Poulter to John Everitt by request to Thomas Henry Cox, and 10 shillings paid by Cox to Everitt the premises are conveyed All that: parcel or plot of land (coloured plan in deed) in King Street, Luton, bounded: - northwest: King Street - northeast: messuages and premises of John Everitt - southwest: messuages and premises of John Hodge - southwest: messuage and premises of Robert Marsh And also that William Henry Cox and John Everitt and their heirs administrators and assigns to claim a right of way and passage of Thomas Poulter and heirs to the premises with or without horses, carts, wagons or carriages of all kinds along King Street, with all ways, paths, passages and waters, privileges to the plot of land belonging. To have and to hold the plot of land and hereditments conveyed to Thomas Poulter and assigns for ever. And Thomas Poulter declares that his widow, if any, shall not be entitled to dower in to or out of the said plot of land. And William Henry Cox shall not do any act which encumbers the premises with charges. And that Thomas Poulter and heirs shall not erect or permit to be erected nay building having a frontage on King Street of less than 33 feet from the level of the road not containing fewer than three stories, and that such erections shall be contained within the building line. And that the said road shall be dedicated to the public and taken to by the Parish, and that Thomas Poulter his heirs and assigns shall pay to John Everitt and his heirs and assigns a fair proportion of the expenses in keeping the road in repair, the proportion to be ascertained by dividing the expense by the number of feet frontage of all the buildings fronting the road. And John Everitt and heirs shall covenant with Thomas Poulter and heirs that john Everitt and heirs, unless prevented by fire or inevitable accident, will produce title deeds on request and produce copies if necessary.
