Recites will of Sir Coventry Payne, made 5 June 1874, proved Principal Probate Registry 2 September 1874. Recites Payne at his death also entitled to following real estate: in Wootton - Berry Farm, subject to a mortgage dated 1 August 1873 in £7000 (J H Blood, mortgagee); estate in Wootton and Kempston Hardwick and Rectorial Tithes (Monoux Estate) subject to mortgage (Sir John Tyssen Tyrell Bart, William Michael Tufnell, Herbert Keigh and John Wright) to secure £7444 15s 3d and interest at 5% per annum; estate in West Indies. Residuary personal estate of Sir C Payne included furniture and effects at Wootton House AND 'sum of £2000' charged on an entailed estate of which Sir Coventry had been life tenant. Debts exceed value of residuary personal estate. Recites:- case Church v Wright 1874, started by John Church on behalf of him and all the creditors. Recites order of 6 December 1875 permitting W H Wright to raise mortgages of £10,000 of Sir Coventry Payne's real estate. Details re these mortgages and orders confirming them and the debts involved. Recites death of J H Blood 5 August 1876. Recites his will appointing Howell Pattison, Lewis Blood, and William Bindon Blood his executors. Will made 4 August 1876, proved Principal Probate Registry 1 September 1876. Recites Mortgage of £1,000 at 4% Interest and interest: 1) Philip Monoux Payne (Mortgage); 2) Gerard Bixby Laurence: all his interest under Sir Coventry Payne's will in the Berry Farm and all his interest in any other real or personal estate under said will. 27 October 1911. Recites Further Charge of £1,000 and 4% interest: 1) Trustees of Sir Coventry Payne's will; 2) C E Leigh and J C Townsend; 3) Sir P M Payne and Dame Winifred Payne his wife; 4) Henrietta Anna Maria Townsend and Philip Charles Townsend, Richard Johnson Townsend (2 children of Henrietta's); 5) Gerard Bixby Laurence (entitled to charge on estate - see above); 6) Joseph Aurelisus Weston, Receiver under consolidatory mortgage in place of John Rogers deceased. 15 November 1912. Recites death of Henrietta Anna Maria Payne (Townsend) on 20 March 1913. Recites her will appoints H M Leigh and C H W Marriott trustees in so far as £500 pa to be raised according to Sir Coventry Payne's will in trust for 2nd son Richard Johnson Townsend when 21. Will made 21 October 1903, proved Principal Probate Registry 16 August 1913. Recites Richard Johnson Townsend now 21. No mortgage ever executed to raise the £500 pa, Dame Henrietta did not receive full sum of £500 pa. Recites argument between Townsend and P Payne in which he would receive furniture and effects from house at Hastings + investments.
Recites 2 sums of £7,467 0s 1d and £1,000 still owing on Consolidating Mortgage etc. Richard received some money in respect of £500pa since Henrietta's death, accepts this in full satisfaction for any claims he might make relating to it. Recites R J Townsend and PM Payne agree Real Estate insufficient to raise Mortgage to produce £500 pa therefore unsold real estate to be vested absolutely in R J Townsend in full satisfaction of claim (subject to Consolidated Mortgage and Further Charge) indemnifies Payne against Death Duties of Henrietta.
