Reciting various matters [Details given] Now in consideration of said £2540 paid by (iii), (i) and (ii) grant, bargain and sell to (iii) messuage or farmhouse, lands etc situate in Marston Moretaine (as in schedule), which are free of land tax, and in the occupation of Mr John Iliffe (as shown on plan) to use of (iii) or (iv) in trust for (iii). Schedule relates to 117 acres 30 perches land. Copy signatures of (i), (ii) and (iii).     Details given: Reciting will of Thomas Baskerfeild, the Friary, Colchester, Essex, esquire, dated 20 December 1815 by which he bequeathed to his wife his house at Colchester, certain stock, and residue of his property. Friends, Horatio Cock, esquire, of Colchester, and (ii) appointed joint executors. He bequeathed £100 stock from his five per cents to his 12 first cousins - Mrs Bray, Mrs Frances Brandreth, Mrs Alice Brandreth, Mrs William Gape and her 3 sisters, Mrs West, Mrs Elizabeth Baskerfeild and Mrs Catherine Baskerfeild, Mrs Mary Margaret Baskerfeild, Mrs Catherine Baskerfeild her sister, Mrs Thomas Baskerfeild, Mrs Burrell, and the children of his deceased cousin Captain William Alston Brandreth, share and share alike. He desired that said wife would allow his 2 cousin Brandreths of Redbourne to live rent free. Also to allow them certain annual payment. £10 given to poor of Redburne. After death of wife, property to be sold and divided among 12 first cousins, and their children. He died on 1 December 1816, leaving Ann Gape, Catherine Baskerfeild, Elizabeth Baskerfeild and Mary West as his first cousins and co-heiresses at law. Catherine Baskerfeild died in April 1825. Elizabeth Baskerfeild died in May 1830. Ann Gape died in March 1837. Mary West died in January 1838, leaving Thomas Baskerfeild her first cousin and heir at law. Said Thomas Baskerfeild died in October 1838, leaving Catherine Walton his only daughter and heiress at law. Catherine Walton died on 18 August 1849 leaving (i) her eldest son and heir at law. Will of said Thomas Baskerfeild was on 21 January 1817 proven by Sophia Baskerfeild in Prerogative Court of Canterbury (PCC). Sophia Baskerfeild died in November 1846. Will of testator proved on 10 April 1847 by Joseph Maberley alone (Horatio Cock having died) in PCC. By Decree of High Court of Chancery dated 28 April 1849, in which Peter Ashwell Burrell was plaintiff and (i) and (ii) and others were defendants, it was declared that parties entitled to his residuary property became entitled as personal estate, and subject as aforesaid, whole of residuary property became vested in his 11 first cousins and the children of W A Brandreth. Ordered that residuary real estate be sold and proceeds paid into Bank of England. Said messuage, farm etc were put up for sale by public auction on 18 July 1850 in 8 lots (the fifth lot comprising the messuage or farmhouse hereinafter mentioned). At said sale (iii) was declared purchaser of 5th lot for £2540. Money paid into Bank of England to credit of cause Burrell v Baskerfeild.
