    Samuel Atwood: on 1 September, he was returning from the garden of Mr Nichol, in the company of the prisoner. They passed some new cottages built by Mr Cheshire & Mr Potton. There were some bricks lying there. The prisoner picked up the bricks 2 or 3 at a time and put them in his wheel barrow. He wheeled them off into Mr Nichols garden. Atwood went and told Mr Cheshire and gave the bricks to Constable O'Brien. He showed Thomas Potton the heap they had been taken from. Thomas Potton: following information he found several bricks missing which had been lying in front of some cottages he was building for Mr Cheshire. He knew the bricks had been there about 7 o’clock that evening. He went with Atwood and O'Brien to William Nichols garden where Atwood showed him the bricks. Cook was given into custody. Dennis O'Brien: he went with Atwood and Potton to Nichols garden and took possession of the bricks.
