    i) John Barber Lindsell, Captain in H.M.Corps of Royal Engineers, and wife Flacilla Matilda Lindsell ii) Frederick Archdale, Biggleswade, esquire (the trustees) Edward Barber Lindsell, Hitchin, Hertfordshire, gentleman iii) Joseph Shuttleworth, Old Warden Park, esquire recites: SL 1/110 : SL 1/119 : SL 1/144 : Indenture of 9 July 1878 between a) John Lindsell b) Harriet Lindsell c) John Barber Lindsell d) Flacilla Matilda Lindsell ( then Flacilla Matilda Bell, spinster) e) Frederick William Steward, William Foote, William Harry Barber Lindsell, Frederick Raymond Barber Lindsell being the settlement previous to the marriage of c) and d) in which a) granted to e) the premises described in the first schedule other than the osier bed and the piece of land and 5 cottages, and all other freehold property of a) in Southill. Also property described in second schedule as are of freehold tenure, in trust for users : Said Frederick Hogg died on 12 July 1878 and was buried at Sandy, and said John Lindsell died on 2 February 1881 and was buried at Hastings cemetery : indenture of even date with this one but executed before between 1) Harriet Lindsell 2) John Barber Lindsell and wife 3) Elizabeth Anna Barber Lindsell (daughter of 2)) 4) Frederick William Steward etc. as above 5) John Barber Lindsell it was witnessed that 1) and Flacilla Barber Lindsell released and discharged all property comprised in indenture of 9 July 1878 and 5) discharged it from yearly rent charges etc. and 4) and 3) from certain trusts mentioned in indenture of 9 July 1878 and 5) from provision of £5000 as portion for 3). So the said terms have become satisfied terms so as to cease and determine : said John Lindsell deceased was only son of said Edward Lindsell, and Elizabeth Lindsell, deceased and said John Barber Lindsell is eldest son of them : said 3 several sums of £2000, £2000 and £2000 (total £6000) are now owing to trustees on security of before recited mortgage etc. : no part of sum of £10,000 raisable under trusts limited by SL1/110 has yet been raised and same still remains chargeable upon property : in treaty for sale was agreed that sums of £6000 and £10,000, part of purchase money should be paid to the trustees in discharge of sums owing and trustees should join in the deed : deeds etc. relate not only to property hereafter mentioned but also to other property and so is agreed that same deeds should remain in custody of John Barber Lindsell now, in consideration of sums of £6000 and £10,000 paid by iii) to ii) by direction of i) and in consideration of £25,000 paid by iii) to i) (total £41,000) i) in exercise of powers vested in them by indenture of 9 July 1878, direct and appoint that property hereafter mentioned should remain to use of iii) for ever also ii) at request of i) grant and release premises firstly and thirdly described in said first schedule etc. and John Barber Lindsell confirms to iii) - all messuages described in said first schedule hereto - messuages comprised in mortgage etc. of 9 November 1866 and 6 July 1878 (SL1/145) or are now vested in the trustees or which are property of John Barber Lindsell in Southill or Biggleswade and lie on West side of River Ivel covenant to produce title deeds 1st Schedule -- capital messuage at Broome, Southill, etc. formerly in occupation of Edward Linsell and now of George Powers -- lands adjoining formerly in occupation of Edward Lindsell and now of various tenants or market gardeners (both – 350 acres) and all other lands at Broome which were formerly the estate of John Barber, esquire, and which upon his decease in 1831 descended to Elizabeth Lindsell (late mother of said John Lindsell) as only sister and heiress at law of said John Barber. said capital messuage is subject to lease of 1 May 1872 between John Lindsell and George Powers in which premises are leased to George for 21 years determinable at the end of 14 years, at yearly rent of £220 2nd part of 1st schedule -- dwelling house and garden etc. at Broom E. High Street S. and W. Isaac Ballard N. part of hereditaments firstly described lately in occupation of Miss Pope but now of Samuel Rook 3rd part of 1st schedule -- Cookes Close (2 acres) in Broome N. Cookes Lane E. Broome Road S. late Lord Ongley W. land next described formerly in occupation of Joseph James -- land containing 3 acres 8 perches in Hill Edge Field in Broom N. Southill Parish Charity estate E.(part) last described land E.(part) late Lord Ongley and now Joseph Shuttleworth S. and part W. " " " " remainder part S. Southill Parish Charity land formerly in occupation of Thomas Brute, afterwards of Edward Brute, his son. Same was formerly known as Bancrofts otherwise Close End which said 2 pieces of land are now laid together and known as Cookes Close -- Dwelling house erected thereon by Edward Ellis, deceased all of which hereditaments thirdly described were formerly in tenure John Looker and now of William Looker 4th part of said schedule *-- 1 acre 1 rood 20 perches ground part of field containing 7 acres 2 roods and 9 perches in Broome S. land and 5 cottages hereinafter described W. Southill Parish Charity estate N. another piece of said field (being premises next described) E. village street with frontage of 85 feet now in occupation of Frederick Woodward *-- undivided moiety late of John Bodger of arable in Broom (1 acre 1 rood 20 perches) formerly part of said field of 7 acres 2 roods 9 perches situated in the N.side and adjoining piece of land hereinbefore described W (part) Southill Parish Charity estate W.(part) part of allotments firstly herein described N. James Chesham E. village street of Broome with frontage of 85 feet also in occupation of Frederick Woodward -- piece of land at Broome (-acres) with 5 cottages built on part E. village street S. part of hereditaments hereinbefore described N. land late Bodgers – hereinbefore described W. Charity land formerly in occupation of –Hall and William and John Chambers, widow Garner and Levi Chambers -- osier bed, part of land at Holme on E.side of Navigation Cut in River Ivel (29 perches) now in occupation of Frances Farmer 5th part -- freehold meadow (originally described as containing 5 acres 2 roods but now by admeasurement 8 acres 39 perches) in Biggleswade, near Mills there, part of Gore and Smith’s Meadow purchased by George Cooper from William Adams E. private road N. meadow, late Lord Ongley, now of John Barber Lindsell, next described. Once called Gore and Smith’s Meadow and formerly in tenure of Montford Cocura, since of John Edwin Watts and now of William Burnage -- freehold ground in Biggleswade (7 acres 3 perches) N. lane from Biggleswade to Broom W. late Lord Ongley, now Henry Henshaw S. lastly described piece E. private right of way lately in occupation of Edmund Powers * Originally sold by Ongley to Lindsell (see SL 1/38 – 43) 2nd schedule settlement of 9 July 1878 release of 30 September 1881 With plan signatures i), ii) endorsed receipts witness Jonathan Hooper with note: “ the mansion of Broom Hall and adjoining lands surrounded by the high roads containing altogether about 35 acres were sold and conveyed to Rupert Oswald Fordham, esquire, 25 June 1894”
