    i) Robert Henley, Lord Ongley ii) Samuel Whitbread, Southill, esquire (only son and heir and devisee in will of Samuel Whitbread, late of Bedwell Park, Hertfordshire, esquire, deceased) iii) Jacob Whitbread, Lawdham Hall, Suffolk esquire John Wingate Jennings, Harlington, esquire ( 2 of the trustees in the will of Samuel Whitbread, deceased, and in Acts of Parliament hereinafter referred to) whereas: i) is seized in fee simple of land in Stanford first hereinafter described : Samuel Whitbread the father being seized of land in Northill lastly hereinafter described, made his will on 24 June 1795 and a codicil on 13 July 1795 and all freehold estates (with certain exceptions not including those hereinafter mentioned) devised to son in law James Gordon, junior, of Moor Place, Hertfordshire, esquire, and to his nephews iii), to use of ii) for his life with remainder to James Gordon and iii) during lifetime of ii) in trust to support contingent remainders. Remainder to grandson William Henry Whitbread, eldest son of ii) by Elizabeth his wife, with ultimate remainder to testator’s rightful heirs : Samuel Whitbread the father died 11 June 1796 leaving ii) his only son surviving him and so ii) became tenant for life of freehold lands thereby devised : James Gordon by deed poll of 19 September 1796 did relinquish trusts vested in him by said will : by Act of Parliament of 38 George III entitled “An Act to confirm the renunciation and release of James Gordon, esquire, as one of devisees in trust of Samuel Whitbread, esquire, deceased, and to give powers of sale and exchange over the settled and devised estates late of Samuel Whitbread and power of charging and appointing new trustees of same estates. And also power of granting building leases of certain parts thereof” it was enacted that all the property which was said last will and codicil of Samuel Whitbread, the father, devised to James Gordon and iii) in trust was properly vested in iii) in exclusion of James Gordon, with full powers as given in said will etc. Also iii) have power (with consent of ii) or, after his death, of others named in Act) to sell, exchange etc. for other lands in Bedfordshire (where lands to be conveyed shall not lie in Essex) of an estate in fee simple etc., all the manors, lands etc. which were bequeathed by will and codicil of Samuel Whitbread the father, and of which ii)was cestui qui use or cestui qui trust for life except the hereditaments in Essex, for money, or lands, or money and lands as iii) shall think reasonable and upon payment of such money as shall arise to the Bank of England as mentioned in said Act. Proper deeds are to be made. : i) and ii) with consent of iii) have agreed to exchange lands of equal value i) exchanges to iii) by lease dated 22 Dec 1800 - newly alloted land in Stanford (13 acres 1 rood 25 perches) N. new enclosed land of ii) in Broom E. and S. new enclosed land exchanged from i) to ii) W. turnpike road to Hitchin being part of allotment lately awarded to i) under the enclosure Act to be held to iii) under uses and trusts as in will etc. iii) exchanges to i) (with consent of ii) by lease dated 22 Dec 1800 - piece enclosed land in Northill, in occupation of Thomas Butcher (11 acres 3 roods 32 perches) W., N.W. John Harvey, esquire, in Northill S. Thomas Butcher in Old Warden signed all witnesses William Neeve William Neeve, junior W. Wilshere Richard Gleadhill I.
