    - Ratifies and confirms settlement made on marriage with Elizabeth. - To wife, Elizabeth, all household goods, implements, furniture, plate, linen, china and liquors. - To son, Thomas, the fifty pounds owing to the testator by his brother, William Bithrey immediately on the death of wife's mother, Mrs Elizabeth Bithrey, the widow of testator's uncle Thomas Bithrey, deceased. - To brother, William all lands, tenements and real estate and goods and chattels and personal estate (except for that in marriage settlement and left to wife and son) to sell and profits of sale to pay funeral expenses, debts. - Residue to brother William and to John Brittain of Chellington, cordwainer in trust to invest as they see fit. All moneys arising by sale , interest and advantage after payment of costs to testator's six children: Mary, Elizabeth, John, Ann, Thomas and Jane in equal shares and proportions to be paid to them as they severally attain the age of 21 or be married. In case any die unmarried and under 21 share to be divided amongst survivors. If all children die before married or 21, or being married leave no child or children then money to wife for life and then to brother's children, William and Elizabeth to be equally divided between them. Interest on proportions for children to be used for their maintenance and education until they are intitled to received their share. Until sale of real and personal estate all interest and rents etc to be paid to wife for maintenance and eduation of children. - If son Thomas be married or 21 at the time of the death of his grandmother, Elizabeth the widow of the late Thomas Bithrey then the £50 should be paid immediately otherwise it should be applied to his maintenance and education. If Thomas dies in the lifetime of his grandmother unmarried or not yet 21 then the £50 to be shared equally between testator's surviving children. - Trustees not answerable for each others actions or for loss unless through negligence. - Guardianship of children to wife who can use as much of their portions as she sees fit to put them forth as apprentices.
