Reciting:
- agreement of 6 December 1877 in which James Pain agreed to sell (a) to (ii) for £725, the sale no being completed although £35 was paid by (ii) as deposit;
- death of James Pain on 4 January 1878 and proof of his will of 17 January 1873 in Northampton DPR in February 1878 in which he devised all his real estate to (i) and appointed them executrix and executor
