Comment made by William Waley on 16 November 1868 with further annotations in a different hand (these shown in brackets): I have perused this Abstract on behalf of the purchaser the Duke of Bedford and the Trustees of the will of the late Duke of Bedford.
1. (As) The title begins in 1852 and from that date is well deduced to dower uses in favour of F. Whitlock (only and the Title prior to that date being, as we are informed, a possessory one a Declaration should be furnished carrying back the Evidence of possession as far as possible)
2. It should be seen that the Indenture of 29th September 1854 was properly stamped for ad valorem duty on £95
3. The plan (furnished by Mr. Bennett) shows the property to contain 23 perches. (How) To this reconcileable with the old description of the land (in the Conveyance of 5th June 1832) as containing 90 poles. The usual searches for judgments &c should be made in the name of F. Whitlock. What is the state of the tenancy?
(4. If vacant possession is not given the particulars of the Tenancy should be stated)
(5. Is the Vendor’s Solicitor aware of any change or incumbrance affecting the property not disclosed by the Abstract of Title)
