    Recites: 1) Copy of Court roll of Manor of Biggleswade. Admission of James Brookes of Kingston Marlwood, Dorset, gent., mortgagee. (on out of court surrender by Albion Throckmorton of hemmingford Abbots, Hunts., gent., on 7 Mar 1746) under mortgage of £2,170 and interest. All messuages held of Manor of Biggleswade 21 & 22 Apr 1752 2) Will of Thomas Brooke of Queen Street, Lincoln's Inn Fields, gent., but born in the city of York: all real and personal estate to loving companion, wife, nurse and friend Anne, daughter of John Pell, late of city of Norwich, and Ann his wife. Made 2 jun 1768, proved PCC 9 May 1770 3) Will of Ann Brooke of Titchfield Street, St Mary Le Bone. to Richard Rudd of Gt. Queen Street, St. Giles in the Fields, Middlesex, gent., all real and personal estate subjest to the following legacies:- to Mary Elizabeth Rudd (Richard's daughter) £500. Reversion to her mother Mary Elizabeth if dies in testators lifetime to Mrs E. Rudd (Richard's wife) diamond rings and jewels to Mary Thackray her late servant, £100 to John Brooke (son of Reverend John Brooke) £500. Reversion to his mother Francis [sic] Brooke if dies in testators lifetime Sole executor: Richard Rudd made 13 Feb 1779. Will proved PCC 25 Nov 1780 4) Decree in Chancery case regarding will of Ann Brooke of Titchfield Street. John Brooke, clerk, plaintiff Richard Rudd, the Reverend John Hubbard and Mary Elizabeth Rudd infant (by Richard Rudd, her father and guardian) Mary Thackray and Charles Frederick Brooke. Brooke tried frequently to get account of personal estate and get £500 paid to him. Rudd refused. Hubbard as testatrix at law disputes will. C.F. Brooke claims to have mortgage on property of testatrix. Rudd claims only real estate Copyhold estate at Biggleswade and moiety of estate at Norwich. Ann Brooke died 8 Oct 1780. Rudd sold moiety for £315 but was still owed £700 by testatrix's estate. Claims Brooke cannot have legacy because personal estate insufficient to meet creditors. Mary Elizabeth Rudd claims her legacy of £500 was to be paid without any abatement and in preference of any other legacy. Thackray claims her £100 can be raised out of real estate if personal estate insufficient. C.F. Brooke alleges in 1757 (margin query 1752-1761) James Brooke (father of plaintiff) was admitted on surrender of Albion Throckmorton, John Parlesward and W.M. Farrer Esqs., in copyhold estates held in Manor of Biggleswade recites deed: 1) James Brooke 2) Thomas Brooke 3) Collins Smith Biggleswade estate to 2) 'in equity' same date as surrender Believes James Brooke lent Thomas £939 12s 3d (much of which was paid off by sale of part of estate) James Brooke died 1785, leaving C.F. Brooke eldest son and heir. Reckons £287 owed by Thomas Brooke's estate to James Brooke's estate (interest 5% from 13 Apr 1781) If paid will withdraw objections to sale of copyhold land Order to Popham, master in Chancery to discover extent of personal estate, extent of debts, etc, especially what was due to C.F. Brooke. Account of sales, rents etc. Advertisement of Ann brooke's creditors in London Gazette. Order sale of rest of testator's real estate. 23 May 1787 5) (added in different hand) Report of Master Popham Sold copyhold estate on 2 lots Lot 1) to William Rands, gardener, for £240; comprises house or cottage (with cottage right) now or late in possession of Samuel Barber at year rent of £4 4s 0d Piece of pasture called Forsters Close (in possession of William Knight at yearly rent of £5 15s 0d) Four houses in the possession of Thomas Page, William Leman, widow Burroughs, William Chapman on a site of ground containing 3 roods (with cottage rights) at yearly rents of £2, £2, £3 and 10s 12d respectively.
