- Scope and Contentin consideration of the love and affection he bears to Elizabeth his now wife and to John Birchmore her son, and to the better maintenance and livelihood of her the same Elizabeth in case she should outlive the said Thomas Marsam, (i) covenants to (ii) in trust: (to the uses of (i): a messuage with backside and appurtenances in Church Street, Luton, lately purchased of Thomas Feild of Crawley Green and now in the possession of (i) for uses and intents as follows: for the use of (i) and his wife Elizabeth for the life of the longer liver; after to John Birchmore, Elizabeth's son and (i)'s heir, as long as John Birchmore gives his sister Susan, wife of Rice Evans of Markyate Street, Caddington, Herts., the sum of £20 within two years of (i)'s death and (i)'s wife. If any default in payment or time of paying, then the use of the messuage passes to Susan Evans. Note that (i) is indemnified from all previous bargains. witnessed: Richard Birchmore, William Fisher. Endorsed with receipt for the £20 signed by Susan Evans on Nov. 15th, 1704.
