- Scope and Content- - A messuage in parish of Roxhill and Marston Moretaine with all buildings, grounds, commods. etc. belonging thereto within said parsish, all now occupied by John Tuffnaille or assignees EXCEPTED AND RESERVED: all trees, hedges and bushes growing on the premises during this lease with lops and tops; and also liberty to view and survey the premises at seasonable times. RENT of £22 to be paid at dwelling of (i) at Michaelmas next, and thereafter one quarter of the annual rent to be paid at the same place at the 4 usual feasts; in case of default by 94 days after any such feast, if it be lawfully demanded at said dwelling, (i) to have the right of re-entry. (ii) to have the right to lop trees formerly used to being lopped (other than oaks) and in good 'husbandly' manner and at seasonable times of year to plash hedges and bushes of at least 16 yrs., to scour up ditches, to make hedges sufficiently and to take of lops and plashings for his own use to be used upon the premises 'in an indifferent proportionable manner yearly'. CONVENANT by (ii) for self, exors. administrators and assignees that they will not plough up or convert to tillage any pasture meadow or sward hereby demised; that they will at their own charge do all repairs as required - only great rough timber is to be allowed by (i) - and at the end of the lease will leave the premises well and sufficiently repaired; they will keep all arable in good heart and will not sow more than 2 years together without leaving one year fallow and making a summer's tilth; only for four years yet to come it must be as it is granted to Sir John Tufnayle by his lease. PROVIDED that (ii) shall not let, sell part with assign this lease of the said premises or any part thereof without consent of (i), his heirs and assignees, in writing under their seals, on pain of forfeiture of this lease and of so much money as (i) 'shall happen to be thereby hindered or dampnifed'; ALSO (ii) or assigns shall not commit or suffer to be committed any manner of waste on any of the premises. COVENANT by (i) for self, heirs, executorors and assignees for peaceful possession by (ii) of premises hereby leased.
