    Recites: - Indenture dated 9 April 1864 1) Mary Ann Herbert of 88 Bishopsgate Street, London, spinster. 2) Elizabeth Herbert of Kildare Terrace Bayswater, spinster, 3) Harriett Helen Herbert of same, spinster, 4) George Hawkins of 88 Bishopsgate Street, merchant and James McFarlane of Dunfermline, Fife, writer to the siguet, 5) Henry Robert Russell of Hawkes Bay, New Zealand, gent and Susannah Cobham his wife. 6) William Pope of Biggleswade, merchant. Turner Boston late of Biggleswade by will dated 25 March 1795 devised all real estate to sister Anne Downe wife of John Downe gent for life with remainder to John Downe for life with remainder to children of Anne Downe. Turner Boston’s will proved 27 May 1800. Ann Downe admitted tenant to copyhold 29 & 30 April 1800. Ann Downe had one child – Mary Ann Downe. Marriage settlement of 18 Oct 1809 settled all copyhold in Bedfordshire and Middlesex to use of John Downe for life, then Ann Downe for life then Mary Ann Downe for life then Nathaniel Vincent Herbert for life and then to children of N V Herbert and M A Downe equally divided. Indenture of release dated 30 June 1810 between 1) Sir Francis Willis, 2) John Downe and Ann, 3) Nathaniel Vincent Herbert and Mary Ann enfranchised the copyhold in Biggleswade. John and Ann Downe died. N V Herbert died 7 Feb 1854. N V & M A Herbert had 8 children: George Herbert died 1821 aged one week, Sarah Herbert died 1831 aged 12 years, Charlotte Herbert died 1832 aged 19, Mary Ann Herbert, Elizabeth Herbert, Harriet Helen Herbert, Susannah Cobham Herbert and Dennis Herbert. Marriage settlement of 9 June 1846 for marriage of Susannah Cobham Herbert to Henry Robert Russell made George Hawkins, James McFarlane trustees to one equal fifth share. Dennis Herbert died 1847 unmarried leaving sisters co-heiresses. Mary Ann Herbert the mother died 28 March 1862 leaving property to be divided equally between her four daughters. Agreed to absolute sale to William Pope of common right thereftofore enjoyed with the copyhold hereditaments but intended to be thereby severed therefrom for £95. - All that right of common or pasturage for one horse and two cows and all other rights of commoning whatsoever which theretofore belonged or appertained to or was lately held and enjoyed with a certain messuage near the Market Place, Biggleswade then or late in the occupation of Mrs Taylor, which messuage was lately sold to Thomas Powers which said right of common was then lately let to & stocked by Montfort Docwra and numbered 26 in the fen reeves books. Various convenants.
