    Gilbert Smyth, rector of St. Peter de Merton; Wm. Barton and Ingram Pass (iconimi) churchwardens, Robert Colyer, Thomas Cheltenham, and all parishioners. James Moston. There has been a dispute about 8d. rent payable from time immemorial towards the church fabric, for a garden in the said parish, between the highway E., and a chantry W., extending from the highway to a pightle of the church. John Litylbury and John Blythe enfeoffed Jas. Moston of the garden, and the latter refused to pay the rent. The matter was submitted to Thos. Hore, master of St. John's Hospital, and John Legat, master of St. Leonard's Hospital; who say that Jas. Moston & his wife Emma should pay the 8d. rent; the rector should pray for them every Sunday by name and should also pray for the souls of Thomas Blythe and Agnes, his wife; and every 4th. and 6th. weekday (feria) at mass the Rector should say for James and Emma and other benefactors the collect beginning "Deus qui caritate" and for Thomas and Agnes Blythe that beginning "Omnipotens sempiternus deus", and the same for the souls of James and Emma when they die. If the prayers are omitted the rent may be witheld; and if the rent is withheld, the churchwardens can distrain.
