(ii) Frederick Hurst of Upper George Street, Luton, bleacher Reciting: - will of Emma Gregory of Luton of 20 Jan 1871devising and bequeathing her real and personal estate to (i) upon trust for sale; - death of Emma Gregory on 11 Oct 1874 and proof of her will in Northampton DPR on 6 Nov 1874 Operative Part: - (i) conveyed (a) to (ii) for £230 Property [as shown on attached plan]: (a) cottage, bleaching and dyeing premises adjoining, yard and premises in Upper George Street, Luton in occupation of Frederick Hurst; John Welch of Sussex Place, Regents Park [London], merchant; Alfred Phippen Welch of Stanmore [Middlesex]; Charles Edward Gaselee of 90 Lower Thames Street, London (executors and trustees of John Davis Welch, late of Gutter Lane, Cheapside [City of London] and Luton, straw hat merchant and manufacturer, deceased); - since the two indentures the land coloured yellow in an accompanying plan [NE corner of Gordon Street and Upper George Street and north side of Upper George Street bordering a passage to west] had been sold to John Hill and J.Webdale respectively; - indenture of 30 Jul 1860 in which (1) John Welch (since deceased) conveyed to his sons (2) John Davis Welch and Alfred Phippen Welch the property conveyed in the indentures in the second schedule; - in 1871 John Welch, son of John Davis Welch, was admitted into partnership by his father and Alfred Phippen Welch but no partnership deed or conveyance was ever executed; - in 1874 Alfred Wood Welch, son of Alfred Phippen Welch, was admitted into partnership by his father and John Davis Welch but no partnership deed or conveyance was ever executed; - in 1876 Alfred Wood Welch retired from the partnership but no deed of dissolution was ever executed; - will of John Davis Welch of 26 Oct 1875 appointing (i) as his executors and trustees and devising and bequeathing all his real and personal estate to them upon trusts; - death of John Davis Welch on 7 Apr 1880; - proof of will of John Davis Welch on 30 Apr 1880 in PPR; - the amount of share of John Davis Welch in the partnership at the time of his death had been settled and that remaining unpaid secured to (i); - an adjustment had lately been made between (v) and (iii) "in reference to matters of business in which they are jointly interested" under which it was arranged that (v) should be entitled to (a) for his own use and benefit Operative Part: - (i) conveyed title to (a) under the will of John Davis Welch to (iv) Property: (a) plots of land described in parts 1 and 2 of 1st Schedule other than the portions conveyed to John Hill and J.Webdale Habendum - to (iv) to use of (v) with the intent that (v) should hold (a) discharged from all claims of (i)-(iii) 1st Schedule [as in attached plan] 1st Part - land on which a dwellinghouse, cottages, warehouse, bleach house had formerly been erected on NE side of Upper George Street, Luton partly fronting onto the road conveyed to John Welch, John Davis Welch and Alfred Phippen Welch trading as Welch & Sons by indenture in 1st part of 2nd Schedule;
