Recites
1) has unencumbered fee simple possession of an equal undivided moiety under the will of William Henry Elger, deceased proved 18 June 1868 the other equal undivided moiety 1) has on trust to sell by auction or private contract.
1) has contracted with 2), 3) and 4) for the sale of these hereditaments.
Consideration £39 12s 9d half to 1) as beneficial owner and half to 1) as trustee.
- plot of land in Mother Field in the parish of Cardington being part of a larger piece of land recently divided and sold in lots by Thomas G E Elger and which said piece hereby conveyed comprised Lot 19. Bounded North by the road leading into the proposed new street, South by Lot 21 sold to Samuel Saunderson, East property of the Trustees of the Bunyan Meeting House, West by the proposed new street intended to be laid out by 1).
Covenant that 2), 3), and 4) will keep in repair the half width of the proposed new street so far as the land is bounded by it from the time that it is laid out with 6 inches of gravel or other hard material until such time as the new street may be taken over by the District Highway Board, and that the main wall of any building erected on the land will not be nearer to the new street than 5 feet, and to erect a wall or fence in the southern side of the land within six months.
1) acknowledges the right of 2), 3) and 4) to see an indenture dated 22 June 1865 between John Elger, Emily Elger, William Henry Elger and Thomas Gwyn Empy Elger.
