Draft Transfer of Mortgages
Parties:
(i) William Anstee of Tythe Farm, Chalton, farmer; Benjamin Bennett of Cheverells Park near Dunstable, esquire; John Kinder of Church House, Harlington [Middlesex], esquire;
(ii) William Anstee;
(iii) Sir George Bourchier KCB of St.Margaret's, Twickenham [Middlesex], retired major general; Charles Elton Longmore of Hertford, solicitor
Reciting:
- mortgage of 1 Apr 1855 in which (1) Thomas Sworder of Luton, brewer borrowed £1,450 from (2) John Anstee of Lewsey Farm, farmer adding to £500 advanced previously on security of (a) Eagle public house on corner of Beale Street, Dunstable built by John Gray and in occupation of Thomas Gostelow; (b) two cottages adjoining (a) in occupation of John Cox and Harrison; (c) ten cottages in Town Hill, Luton adjoining Horse & Jockey public house, formerly in occupation of Dinah Terry, George Powell, Bunker, Dimmock, William Almond, James Anderson, William Field, James Brown, Wright and Cook then George Bilcock, James Shrimpton, Henry Lawford, William Cumberland, James Hill, James Scales, John Andrews, Leonard Fletcher, James Carter and James Bottoms;
- Thomas Sworder paid John Anstee £500 shortly the above mortgage;
- will of John Anstee of 20 Apr 1869 devising all mortgaged properties to (i) as trustees subject to equity of redemption;
- death of John Anstee on 14 Aug 1870 and proof of his will in PPR on 21 Jan 1871;
- mortgage of 29 Nov 1880 in which (1) Thomas Sworder borrowed £500 at 5% interest from (2) William Anstee secured on (a)-(b) above, (c) two messuages erected on the site of two pulled down messuages in Tower Hill otherwise Manchester Street, Luton in occupation of Francis Merchant and (d) eight cottages , four of which were then used as warehouses in rear of (c) and adjoining Horse & Jockey;
- £1,450 and £500 were still outstanding but all interest had been paid
Operative Part:
- (iii) paid £1,450 to (i) and £500 to (ii);
- (i) and (ii) transferred the respective mortgages and security to (iii)
