  • Scope and Content
Item previously catalogued with nine others as "Nine papers including statements of cases, abstracts of title, and lists of properties, several throwing light on history of firm, 1853-89" Memorandum in reference to Mortgage from Thomas and Robert Sworder to Thomas Sworder "As to the description of the piece of Land firstly described on which stand the Brewery and the Crown and Anchor. The description follows that in the Conveyance to Messrs T & R Sworder, but there is evidently a mistake, for the North East is mentioned twice & the second time it is mentioned the boundary is stated to be the South Eastern Bank of the River, but if the North Eastern side of the land abuts on the River, it would be on the South Western Bank and so it is stated in the Conveyance from Lord Bute. It would therefore seem that it shold be so altered; and also that the first mention of the North Eastern Boundary as being by land of Gray must be incorrect - the description should be rectified in these particulars. The description had better be altered - there is no doubt it ought to be the "South Western Bank". As to the Deeds As to the Premises firstly described The Brewery and the Crown & Anchor are held under Conveyances from Lord Bute of 3rd Oct 1843 & 17th July 1844. These Deeds are here, but there is no covenant by Lord Bute to produce Deeds, was there not a simple Deed of Covenant? I believe there was no separate Deed of Covenant as Lord Bute's title was so very long purchasers of small lots invariably took merely a simple conveyance without entering into the title. The Bute Arms Public House is held under another Conveyance from Lord Bute dated 25th January 1844. This is not here, nor is there any covenant for its production who holds it? Mr.Lovel Smeathman, a former Mtgee of this (with other) property still holds this deed. Is there not an abstract of title to the Brewery Premises? I have a copy of the abstract delivered to me on our purchase, but the original I think you will find you have in your possession. Also the "Boot" Public House? This abstract was also left with the Deeds I believe. As to the Premises 2ndly described Is there also not an Abstract to the ground purchased of Everitts? No abstract was delivered on our purchase. Everitt's conveyance was executed the same day as he conveyed it to us. There is an abstract relating to the "Volunteer" which does not appear to concern any property in mortgage to Mr.T.Sworder, and it is therefore returned".
