Incumbrance incurred by Rose Eliza Field the elder and Rose Eliza Field the younger:
- further charge of 400 on (c) from 5 June 1862 from Charles Tylecote and Richard Freeman
Recites Will 8 April 1859 of Thomas Flint Field, esq, late of old Fielden
executors: Edward Danns, or Dans, Roberts, Henry Powell gent of Finchley Rd, Middx, and testator's wife & daughter as in (3) above
- after a specific bequest, all real estate & residue of personal estate to the executors in trust to pay to Rose Eliza Field the elder the rents from the estate for her to maintain, clothe and educate their daughters Rose Eliza Field and Amelia Field during their minorities and for so long as they they reside with her
- after death of wife, 200 pa to each daughter and the residue invested by the Trustees and the profits used to pay off the mortgage; but the trust for accumulation should not last beyond 21 years after his death
Recites Thomas Flint Field died 19 July 1861, will proved 21 Sept, his freehold and copyhold estate consisted of (a) to (h), subject to the said incumbrances
Recites the residual personal estate was not sufficient to pay his funeral and testamentary expenses so (3) borrowed 400 to discharge the debts
Recites William Henry Powell died 20 August 1865
Recites (3) borrowed 200 and 300 in 1867 and 1871
Recites (e) was sold in 1875 to the Commissioners of Servers of the City of London for 8400 pursuant to an order from the Court of Justice (Chancery Division) 1875 in the matter of the trust estate of Thomas Flint Field to discharge all the incumbrances except the 200 and 300
Recites the remaining unsold copyhold estate of Thomas Flint Field is now legally vested in Edward Danns Roberts
Recites that except for (h) which is legally vested in Agnes Emily Rooke, the remaining unsold freehold is vested in (1)
Recites the 2 daughters have now attained 21 years so the Trust has ceased, and Edward Danns Roberts has agreed to pay 200 annual rent charge to Amelia Field from the copyhold
