Deed of Appointment Parties: (i) Francis Fowler of Henlow, farmer; Marian Fowler of Henlow, spinster; (ii) Frederick Archdale, Robert Henry Lindsell, Charles Samuel Lindsell and Arthur Knox Lindsell all of Biggleswade, bankers; (iii) John Hare of Henlow, corn merchant; (iv) John Weston Whitaker of Henlow, brewer; (v) Samuel Lucas of Hitchin [Hertfordshire], brewer Recitals: - indenture of mortgage following WL1000/1/HENW/1/19; - the surrender had not been enrolled in the Manor of Henlow Lanthony court rolls; - death of Francis Fowler on 5 Dec 1880; - will of Francis Fowler of 17 Dec 1879 (proved in Northampton DPR by (i) on 12 Jan 1881) devising to (i) all real estate, subject to equities of redemption etc. and making (i) executor and executrix; - indenture of 17 Mar 1879 in which (iv) covenanted with (ii) to repay money borrowed from them on overdraft with interest at 5%; - in same indenture of 17 Mar 1879 (iv) covenanted to surrender (a)-(c) to (ii) to their use until repayment of the overdraft; - no such surrender was subsequently made; - (iv) filed a petition for liquidation under Bankruptcy Act 1869 at Bedford County Court on 23 Mar 1881 and (iii) was appointed trustee of the estate on 13 Apr 1881; - (a)-(c) were sold at public auction in Biggleswade on 27 Apr 1881, (v) bidding 460 for them (as Lot 4); - 300 was still owing on the mortgage to Francis Fowler deceased with 11/5/- interest; - sum considerably in excess of balance was due on indenture of 17 Mar 1879 Operative Part: - (v) paid 311/5/- to (i) and 148/15/- to (ii) and (iii) conveyed (a)-(c) to (v) Property: (a) beerhouse in Henlow in occupation of Leman Doe; (b) two cottages in occupation of William Johnson and George Huckle; (c) three cottages in occupation of James Legate, Frederick Bywaters and Frank Mossman (a)-(c)'s abuttals being the same as in WL1000/1/HENW/1/14 Witnesses: - Thomas Hooper of Biggleswade, solicitor; - Charles Veasey of Baldock [Hertfordshire], solicitor Presented at Court of Manor of Henlow Lanthony on 12 Aug 1881
