    Marriage Settlement Parties: (i) Lady Isabella Frances Fitzroy, daughter of George Henry, Duke of Grafton by Charlotte Maria, Countess of Euston, deceased; (ii) Henry Joseph St.John of Mount Street, Grosvenor Square [Middlesex], esquire; (iii) George, Earl of Jersey and Lord John Fitzroy, brother of Duke of Grafton Recitals: - intended marriage of (i) and (ii); - marriage treaty specified that 2,569/14/2 bank stock, 3,372/7/2 bank new 4% annuities, 33/6/8 bank long annuities and 1,856/8/3 bank 3% reduced annuities (making 6,829/15/11) of (i) should be transferred to (iii) upon trusts; - that the sums noted above had been transferred to (iii); - indenture of 27 Aug 1829 between (i)-(iii) (endorsed on marriage settlement of George Henry, Duke of Grafton and Charlotte Maria, Countess of Euston of 4 Jun 1794) in which (i)'s third share in manors etc. in Cambridgeshire directed to be sold and the proceeds invested were, by her, assigned to (iii) upon trusts Operative Part: - the sums totalling 6,829/15/11 were transferred to (iii) in trust as follows; - the sums from the sale of Cambridgeshire manors were transferred to (iii) in trust as follows: - the interest to be paid to (i) for her sole use; - principle sums to be assigned according to (i)'s last will and testament, in default to children of (i) and (ii), in default to (i); - (iii) paid 10/- each to (i) and (ii) and (i) and (ii) covenanted with (iii) that if (i) or (ii) in her right became possessed of personal estate it should be vested in (iii) in trust Provisoes: - lawful for (iii) after the death of (i) to levy portions for children of (i) and (ii); - lawful for (iii), with consent of (i) to sell parts and invest the proceeds; - appointment of new trustees Witnesses: - John Parkinson of 66 Lincolns Inn Fields; - Francis Worship of 66 Lincolns Inn Fields; - James Curtis Eastman of 66 Lincolns Inn Fields ENDORSEMENTS: - Memorandum of 6 Nov 1845 that 5,940, legacy of 6,000 from George Henry, Duke of Grafton to (iii) after dedction of Legacy Duty was invested in 6,269/2/7 3% consolidated annuities; - Memorandum of 21 Aug 1850 that 8,315/15/10, share of (i) as one of the six younger children of George Henry, Duke of Grafton, from sale of Cambridgeshire manors was paid to (iii) and invested in 8,628//11/6 consolidated 3% annuities; - indenture of 14 Mar 1857 of appointment of John George Smyth, esquire, of Heath [Yorkshire] and Sir Robert George Throckmorton of Buckland [Berkshire], baronet as trustees following death of Lord John Fitzroy on 28 Dec 1856 and discharge of George, Earl Jersey, the indorsement also records the death of Henry Joseph St.John on 2 Jan 1857; witnessed by William James Farrer and James Frederick Jarrett, both of 66 Lincolns Inn Fields, A.W.Leith, banker of Folkestone [Kent], Joseph Norman[?], manager of Pavilion Hotel, Folkestone; - indenture of 16 Jun 1870 of appointment of George John Fitzroy Smyth of Heath [Yorkshire], captain in Coldstream Guards and Henry Lee Steere of Ockley [Sussex], esquire as trustees following death of Sir Robert George Throckmorton on 28 Jun 1862 and John George Smyth on 9 Jun 1869 having appointed Richard Beaumont and James Brown as executors of his will of 11 Mar 1861, these being replaced in a codicil by his wife Diana Smyth and son George John Fitzroy Smyth; witnessed by Benjamin Roe and Frederick Willis Farrer, both of 66 Lincolns Inn Fields
