    Release with a covenant to levy a fine Parties: (i) John Palmer of Greenfield, Flitton, Beds, yeoman (eldest son and heir of John Palmer late of Greenfield, deceased who was the surviving devisee in trust named in the will of Thomas Gale late of Ampthill, Beds, brazier, deceased); Elizabeth Gale of Ampthill, widow (legatee named in the last will of Thomas Gale); George Christmas of High Holborn [Middlesex], glazier and Ann his wife; James Egram of Greenfield, Flitton, yeoman and Sarah his wife; John Perrin of Woodstock [Oxfordshire], dealer and Elizabeth his wife; William Elliot of Ampthill, innholder and Pattey his wife and William Hurley of Woburn, Beds, innholder and Maria his wife; (ii) Samuel Davis of Ampthill, Beds, gentleman and John Morris of same, brewer. Reciting: - said Ann, Sarah, Elizabeth and Maria are the five surviving daughters and legatees named in the will of Thomas Gale, deceased; - conveyance by lease and release dated 23/24th Mar 1779 between (1) William Christmas and Ann Maria his wife; Thomas Gale and Elizabeth his wife (2) John Bolding whereby certain property in Houghton Regis, Beds was conveyed to (2) upon certain trusts; - fine between (1) William Taylor (plaintiff) (2) William Christmas and Ann Maria his wife; Thomas Gale and Elizabeth his wife (deforciants); - will of Mary Taylor dated 20th Apr 1789 (see R6/63/7/16) and proved on the 7th Oct 1789; - will of Thomas Gale dated 12th Oct 1792 (see R6/63/16/9) and proved on the 9th Oct 1793; - Thomas Gale died on the 10th Oct 1793; - Mary and Frances Gale, two youngest daughters of Thomas died under the age of 21; - John Bolding died c.1790; - John Palmer died Aug 1804 intestate leaving John Palmer his eldest son and heir at law; - (i) have agreed that the freehold estates of Thomas Gale should not be sold as directed in the will but be settled as outlined below. Operative: - in consideration of the above agreement (i) conveys (a-f) to (ii) upon certain trusts. Property: (a) messuage or tenement called Hoggens where Richard Weild formerly dwelt situate at the E end of Houghton Regis, Beds late in the occupation of John Long, then Joseph Groome; (b) messuages, tenements or cottages formerly part of a Farm House called Jenkyns wherein Elizabeth and Mary Hogg formerly dwelt situate at Houghton Regis opposite to the end of the mansion house late of Henry Brandeth, then of Duncomb; (c) close or orchard of 1r adjoining (b); (d) plot of land which was awarded to (a-b) by parliamentary enclosure; - and also all other property conveyed on the 4th Mar 1779 between William Christmas and Ann Maria his wife and the said Thomas Gale and Ann his wife; (e) two closes of meadow or sward ground in Woburn, Beds known as Barn Close and Corn Close of 5 and a half acres, late in the occupation of Edward Mansell since of James Parrott and now of William Hurley; (f) freehold pightle of pasture ground in Woburn of 1 and an half acres late in the occupation of Martha Woolhead, widow, then George Bosworth and now or late of John Smith, bounded S by copyhold property late of Thomas Ashpole and NE and W by the pasture grounds of the Duke of Bedford; - and all other freehold property of Thomas Gale, deceased. Habendum: - unto (ii) to the use of Elizabeth Gale for her natural life while unmarried; - if decease or remarried: - 1/5th of estate to the use of George Christmas and Ann his wife for ever; (unless they direct otherwise); - 1/5th of estate to the use of James Egram and Sarah his wife and their heirs and assigns for ever (unless they direct otherwise); - 1/5th of estate to the use of John Perrin and Elizabeth his wife and their heirs and assigns for ever (unless they direct otherwise); - 1/5th of estate to the use of William Elliot and Pattey his wife and their heirs and assigns for ever (unless they direct otherwise); - 1/5th of estate to the use of William Hurley and Maria his wife and their heirs and assigns for ever (unless they direct otherwise); Covenants: - (i) covenants to levy a fine on (a-f) to (ii); - signed by (i) and (ii); - witnessed and signed by William Cook; Charles Austin; John Hooper of Dunstable, Beds, solicitor; Nathaniel Cartwright, clerk to Mr. Hooper and Charles Austin, clerk to Mr.Davis.
