    Case for the Opinion of Mr Jacob Edward Jacob of Lincolns Inn, London, was asked by Pearce & Son of Bedford, solicitors, to advise on a claim by Thomas Gwyn Elger that he had prior claim to the purchase of The Green Dragon and the Hassetts estate after an advertisement appeared in the Northamptonshire Mercury on 29th November offering it for sale The document reproduces the correspondence between TGE, Messrs Lucas & Co, solicitors of Newport Pagnell who were representing the sellers, Messrs Pearce who were representing TGE, and William Jones & Thomas Brandon, who made the first offer for the property After seeing the ad in the newspaper, TGE wrote requesting details. Messrs Lucas replied that there was another interested party and that the asking price was £3700: if TGE was interested he should reply by return. TGE sent his servant immediately, but before his servant arrived, WJ and TB had gone to the office of Messrs Lucas and offered £3700, being £400 more than their first offer. When TGE's servant arrived also offering £3700, Messrs Lucas had already agreed to sell to WJ and TB TGE maintained that his correspondence with Messrs Lucas amounted to a contract which they could be compelled to perform. Messrs Lucas disagreed, and WJ and TB offered to sell the property to TGE for £800 more than they had just paid for it. Edward Jacobs gives his opinion that the correspondence did not amount to a contract, just an expression of willingness to treat for a sale; and if TGE wished to pursue his case, it would not be compromised by his accepting the offer from WJ and TB as long as they agreed it was without prejudice
