Operative:
- In consideration of £160/8/- (i) conveys (a) to (ii).
Property: (See attached plan)
(a) Piece or parcel of land at Stuart Street, Luton of 15p; bounded on NE by a garden in the occupation of Miss Haydon; SE by garden belonging to Mr. Cox and in the occupation of (i) and other land of (i); SW by said Stuart Street & NW by the rear of certain premises now occupied by (ii) and others.
- [Plan shows that the property is also bounded on the N by properties of Mr. Sharpe, Mr. Gray, Mr. A. Anstee & Mr. Freer].
- (i) reserves a right of way of the width of nine feet from Stuart Street to a barn recently built by him on ground he has recently purchased.
Habendum:
- Unto (ii) to such uses and trusts as he may direct,
- in default of such direction, to the use of (iii) in trust for (ii) during his natural life,
- reversion to (ii).
Covenants:
- No widow of (ii) to dower out of (a).
- (ii) has right to the production of the following deeds concerning the title of (a):
- Release dated 4th Jul 1843 between (1) John Crichton Stuart, Marquees of Bute (2) Edmund Waller (father of (i)) (3) Thomas Hyde of Luton, surveyor.
- Release & re-grant of annuities between (1) Alice Waller of Luton, Beds, widow; Richard Vyse of Holy Lodge, Luton, esquire & Charlotte his wife and William Stuart of Luton, gentleman & Alice his wife (2) James Waller.
- Office acknowledgement for above dated 14th Sep 1848.
