Scope and Content
"I bequeth my soull unto Allmeghtie God my maker and Redemer" and burial in the churchyard of Luton at the north church door by the wallside. To the poor men's box 4d.; toward the building of the roof of the aisle in the church of Luton 20s. to be paid when they go about to set it up.
To son William Smyth and his issue testator's manor at Howghton Conqueste with all lands, meadows, pastures, woods, rents and services, when he comes to the age of 21, and until then testator's wife Elzabeth to take the profits, and should William die before he reaches the age of 21, then the property to be divided between testator's other sons, and if all his sons die without issue, then property to be divided among his daughters.
To his sons Robert Smyth and John Smyth and their issue the house in Castell Strete where testator dwells, and 3 acres of land, and for lack of issue then the premises to remain to all his other sons,. Robert and John are to enter on the premises at the age of 21.
To son George Smyth and his issue the house in the Churche Strete and an acre of land at the age of 21, and should he die without issue, then property to go to son Thomas Smyth and his issue.
To son Thomas Smyth (after the death of testator's mother-in-law Agnes Monengham widow ) the house in the North Ende of Luton held by copy of court roll for the term of years as in the said copy.
To son William in money £10 to be paid within a year of testator's death, also the silver salt and 6 of his worst silver spoons. To son Robert Smyth in money £10 to be paid at the age of 21, and also 6 of the best silver spoons. To son Thomas Smyth £10 to be paid at the age of 21 and also 6 silver spoons next the best. To son George Smyth at age 21 £10 in money and 6 silver spoons. To son John Smyth £10 in money to be paid at age 21 and 6 silver spoons and a mazer. The portion of any son dying without issue under the age of 21 to be divided among all other sons.
To daughters Jelyan and Elzabeth Smyth in money £10 at age 18 years, each to be the other's heir, and if both die under 18, then their legacies to be divided between all surviving sons.
Wife Elzabeth to have the profits of all his lands and tenements and other legacies until children come of age to receive their portions. Should wife remarry, then her future husband to be bound by sufficient sureties to preserve legacies.
Elezabeth Perat to have 33s. 4d. bequeathed her by the last will of her grandfather William Kylbe, and also the 33s. 4d. left her by Julian Kylbe her grandmother both deceased. Elene Nele and Alys Nele are to have 20s. each left them under the last will of William Kylbe their grandfather, deceased.
Testator's wife Elesabeth to have as much fire wood as she needs for the house where testator now lives so long as she remains unmarried. The rest of the wood is to be sold and the money to be divided among all testator's children. "I will that all my Tymber eveslath and other lath and all my bordes shalbe kepte to helpe to Repare and amende my howses when nede shall requyre". To poor households in Luton 26s. 8d..
