- TitleDraft affidavit of John Thomas Green in Chancery regarding Henry Fowler, a lunatic: - Henry Fowler was entitled to two fifths and one fourth of a further fifth of property in Toddington scheduled in report to Master of the Rolls of 22 Jan 1881; - will of Thomas Fowler of 3 May 1864 devised the property to the living sons of his brother James; - Thomas Fowler died on 20 Jun 1868 and there were five sons of his brother then living - Frederick, Henry, John Charles, Joseph and James; - about 1868 Frederick Fowler got into difficulties and in consideration of John Charles and Henry paying some of his debts he sold them his fifth interest in the property; the conveyance [HN10/273/Fowler3] was prepared and engrossed and Green gave the engrossment to Henry for execution by Frederick but whether execution happened was uncertain; Frederick Fowler afterwards went to Brazil; - Henry and John Charles carried on the business of brewers at Woburn and Frederick Fowler's fifth share of the Toddington property was treated by them as part of the partnership property; the partnership was dissolved in 1872 and Henry took over all liabilities and assets of the brewery but no conveyance was executed regarding Frederick's fifth share; - Joseph Fowler died in Jul 1872 intestate as to real estate and by a family arrangement which was not perfected by any legal document it was agreed that his fifth share of the Toddington property should be divided between the surviving brothers - Frederick, Henry, John Charles and James; - thus Henry Fowler was entitled to his original fifth share, the original fifth share of Frederick and a quarter of the fifth share of Joseph
