Abstract of an Indenture of Settlement dated 30 July 1817 of estates at Allington and elsewhere in Lincs, referred to in the will of the late Rev Montague Earle Welby
i) John Henry, Duke of Rutland; George Gordon, Dean of Lincoln (devisees in trust in the will of Sir William Earle Welby, late of Denton House, Denton, Lincs, bart, deceased)
ii) Dame Elizabeth Welby, widow and relict of said Sir Wm E Welby (being his 2nd wife) and their sons and daughters [named]
iii) Sir Montague Cholmeley, bart Thos Wilson, M.D.
reciting:
- the will of Sir William Earle Welby dated 26 June 1813 and a codicil dated 18 March 1814.
- Said testator died on 6 November 1815. Will proved (PCC)
i) as trustees, at request of ii), release to iii):
- freehold property in East and West Allington, Long Bennington, Bennington Grange and Foston in Lincolnshire, and Arlesey, in Bedfordshire
- in trust for uses in said will, property in Arlesey being subject to 2 annuities of £150 each bequeathed to Charles Cope Earle Welby and to Richard Earle Welby Lincolnshire
- property granted to use of Dame E Welby and then to her sons in tail male and then to the daughters
- Powers of lease, sale, appointment of new trustees etc given
1826 February 18 Dame E Welby dies
1838 November 28 Thomas E Welby [first son] dies a bachelor
1846 May 5 Charles Cope E Welby [second son] dies a bachelor
1871 October 12 Montague E Welby [3rd son] dies a bachelor
1834 November 3 Richard E Welby [4th son] dies a widower without children
1867 July 9 John Earle Welby [5th son] died leaving his eldest son, John Earle Welby, as his heir at law
