(ii) George Bailey of 3 Union Street, Luton, gentleman. Operative: - Mortgage from (i) to (ii) for £90 and interest at £5 per centum per annum. (i) conveys (a) to (ii) as security for repayment. Property: (a) Same as property at Z1121/3/3 with the following addition to the description… 'And also all that messuages, tenements, outbuildings & premises [shops] erected here by Thomas Durrant now in the occupation of William Day'. Habendum: - Unto and to the use of (ii) subject to usual mortgage provisos for redemption including a power of sale. Covenants: - If any default in payment then (ii) has a power of sale upon trust that monies arising should go towards any professional charges arising form the sale, then towards the satisfaction of money owing on the security of these present and any surplus should be paid to (i).
