Articles of Agreement
Parties:
(i) Thomas Sworder of Luton, Beds, gentleman & Thomas Sworder of Hertford, Hertfordshire, gentleman.
(ii) John William Burmester; William Champion Jones & Philip Patton Blyth, trustees of the London & County Joint Stock Banking Company.
Reciting:
- TS of Luton is indebted to (ii) for money secured against certain hereditaments including premises in Luton known as the Queens Hotel.
- TS of Hertford also holds security upon the said real estate subject to the prior claims of (i).
- The said inn and other hereditaments were conveyed to (ii) on the 14th Oct 1863.
Operative:
- (ii) shall not sell the said premises by private contract for any sum less than £3000 without allowing TS of Hertford the option of taking the same for the said sum.
- If (ii) should sell the premises for more than £2000 the further sum over this amount should be applied towards the liquidation of their claims upon TS of Luton and all rent received by them beyond the sum of £100 per annum (being at a rate of £5 per centum per annum on £2000) shall be applied in the same manner.
- Any surplus after satisfying the claims of TS of Luton should be paid to TS of Hertford in order to satisfy his said security.

Endorsement: Declaration dated 18th Oct 1867 by TS of Hertford stating that (ii) have accepted the sum of £700 to discharge all claims and demands on me and i have hereby given up to (ii) all my interest and claims in or to the Queens Hotel, Luton.
