Parties:
(i) Richard Vyse of Luton, Beds, straw hat merchant.
(ii) James Hopkins of Luton, builder.
(iii) Thomas Sworder, gentleman & Robert Sworder, brewer both of Luton.
Reciting:
- Conveyance dated 22nd Apr 1847 between (1) James Kidman then of Biscott, Luton, Beds, farmer & his wife Mary Ann Elliott (2) (i) (3) Thomas Erskine Austin of Luton, gentleman whereby a close a land called Walnut Tree Close otherwise Pykes Close of which (a) is apart was conveyed and assigned to the use of (1) with a limitation to (3) in trust for (1) to prevent any wife being entitled to dower; ultimate remainder to use of (1).
- (i) contracted to sell (a) to (ii) for £300 but no contract had been executed.
Operative:
- In consideration of £456/19/6 (i) at the request and direction of (ii) conveys (a) to (iii).
Property:
(a) Piece or parcel of building ground lately forming part of Walnut Tree Close otherwise Pykes Close at Chapel Street, Luton containing 18 poles,17 yards and 7 feet (Where (iii) has recently built a messuage intended to be used as a inn). Bounded on NE by another part of the said close lately sold to Mr.Thomas William Haselgrove; SW by new road formed by (ii) called Victoria Street; SE by another part of the said close belonging to (ii) and towards the NW by Chapel Street.
Habendum:
- Unto and to the use of (iii).
Covenants:
- No widows of (iii) to dower out of (a).
- (iii) to build a brick wall between (a) and the property of Mr. Thomas William Haselgrove.
