  • Title
Letter from Halse, Trustram & Company, solicitors, at 17 Old Burlington Street, London to John Thomas Green: "The application for Judgement is adjourned until next Wednesday for the Plaintiff to answer the Deft's Affidavit. With reference to the Defence raised by your Affidavit we would point out (1) As regards the Bankruptcy, if the arrangement come to between Mr.Woods & his Creditors was a composition, in order to be successful in the defence it must be proved that the 2/6 in the £ was paid see Edwards v.Coombs 7 L.R.C.P. 519. We assume this was so if the debtor obtained his discharge as stated. Cannot you get an Office copy of this? (2) As regards the defence of the Statute of Limitations payment by one joint maker of a note is sufficient to prevent the Statute running as against the other maker. In your letter of the 3rd inst you mention that the Plaintiff gave a receipt in full satisfaction & discharge of the whole debt & claim against Richard Woods and received the £18:11:4. Have you the receipt and can you verify it by Affidavit as this might have considerable bearing on the joint liability question?
