In reply to the queries contained in your letter of the 17th instant. 1. The Xmas Ground rent has been paid and the receipt will be produced - its bears the same qualification as the others. The only explanation I can obtain is that Mr.Tidey gets a like receipt from the superior Landlord. I consider that the qualification attached to the receipt is immaterial - it cannot prevent the acceptance of Rent being a waiver of past breaches of Covenant. 2. The Fire Insurance Policy will be handed over. 3. It is not known in whose hands the Deed of 2nd June 1870 now is. The Vendor has no copy. All deeds produced by the Vendor will be handed over". 18 Feb 1881 to Alexander Kerly: "The Assignment has been executed by the Vendor and I am ready to complete. When I received the Receipt in its present form I called upon the Solicitors Messrs Surr Gribble & Bunton who told me that the Ground Landlord would not give any other form of receipt - they admitted that the repairs had been carried out by Mr.Christian on the Vendor's behalf in a proper way but I could not obtain anything else from them nor any Allegation of breach of any Covenant. I am not aware nor is the vendor of any breach having been committed. It is not an impossibility for me to obtain evidence to prove a negative" 24 Feb 1881 to Alexander Kerly "I have heard from Mr.Christian this morning and I gather from the papers enclosed that the tenants are all under Notice from him. Would it not be as well for you to see him to prevent any mistake arising and arrange for possession. I do not think anything of the form of receipt given by Tidey for Mr.Christian will tell you that the ground Landlords surveyor looks well after the repairs. I wish the matter was settled" 25 Feb 1881 to Alexander Kerly: "I suppose my course will now be to take out a Summons under the Vendors and Purchasers Act 37 & 38 Victoria: chap 78 sect.9 to settle the question between us and I will (unless I hear from you to the contrary) instruct my Agents on Tuesday next to do so"
