- TitleDraft partial revocation of the trusts of a marriage settlement dated 3rd Dec 1883. Parties: (i) Dame Flora Pauncefort Duncombe of Moreton Manor House, Buckinghamshire, widow. (ii) Arthur Lucas of Woburn, Beds, esquire. (iii) John Matheson Macdonald of 3 Lombard Street, City of London, esquire; Sir Kenneth James Matheson & George Augustus Duncombe of Beverley, Yorkshire (trustees). Reciting: - Marriage settlement dated 3rd Dec 1883 between (1) Sir Philip Henry Pauncefort Duncombe (then not a sir) (2) (i) then Flora Matheson (3) (iii) (4) Lambort Henry Bouwens - intended on the marriage between (1) & (2) whereby a trust fund was established comprising of the shares and premises (2) was entitled to in reversion upon the death of her father Alexander Matheson (an annual sum of £400 with residue to (1) during their lives and then to their children subject to certain limitations contained including that the first son of 21 should be entitled to the first estate in inheritance of land and property in Bucks and be void of the recited trust) and (1) & (2) are given certain powers of revocation and appointment. - (1) & (2) had two children: Constance Flora Eleanor Pauncefort Duncombe, born 5th Dec 1884 and Everard Philip Digby Pauncefort Duncombe (now sir) who was born on the 6th Dec 1885. - Everard Philip Digby Pauncefort Duncombe became entitled to the inheritance of land and property in Bucks. - Sir Alexander Matheson died on the 26th Jul 1886 and (3) received £25,000 assigned to them in trust to use as trust fund and pay out as stated in recited marriage settlement of 3rd Dec 1883. - (1) died on the 26th Aug 1895. - (4) died on the 20th Sep 1902. - Intended marriage between (i) and (ii) and on completion (i) is desirous of executing a revocation and new appointment. Operative: - Revocation and new appointment of recited marriage settlement by (i) whereas payments from trust fund should continue to (i) during the residue of her life and after to (ii) for the residue of his life and then to any children of the marriage who have attained age of 21. Covenants: - If marriage should not be solemnized in the next 6 months then the revocation should be void. Schedule included showing the money and investments now subject to the trusts of the recited marriage settlement.
