    Letter from May, How & Chilver of 49 Lincolns Inn Fields, solicitors to F.T. Tanqueray… 'We received your letter of the 13th instance and have today had an opportunity of discussing it with Lady Duncombe who has instructed us to say that a settlement by Mr. Lucas on the lines indicated therein will be acceptable to her. It is, however, suggested that the power of appointment over the capitol, to be given to Lady Duncombe & Mr. Lucas jointly and to the survivor, should not be limited to children, but, as is usual, should extend also to remoter issue… We therefore suggest that, in the present instance, we should prepare the draft of the settlement to be made by Mr. Lucas and send it to you for approval. Will you kindly supply us with particulars of investments representing the £10,000 which Mr. Lucas will bring into settlement, and let us know the names and addresses of the trustees whom he will nominate? We suggest that there should be four trustees, two nominated by Mr. Lucas and two by Lady Duncombe. As promised we send you an extract from the settlement made on Lady Duncombe's first marriage showing the power of revocation and appointment given to her in case of subsequent marriage. Lady Duncombe proposes, within the limits of the last proviso but one contained in this extract, to exercise the power in such a way that Miss Pauncefort Duncombe shall take not less than £10,000 of the whole fund (unless that sum represents more than half of the whole fund in value, in which case Miss Duncombe will take half the whole fund only) and that a sum not greater than £15,000 shall be appointed in favour of Mr. Lucas and the issue of her marriage with him. The present value of the fund is about £22,300. The trusts will be after the death of Lady Duncombe: - If Mr Lucas has not incumbered his interest, to pay the income to him if he survives her for his life or until he shall attempt to incumber such income subject thereto for children or remoter issue as Lady Duncombe may by deed or will appoint, in default of appointment, for all the children equally, sons at 21, daughters at 21 or marriage'.
