(1912 A.No861) Drawn up by Halse Trustram & Co. of 61 Cheapside, London: - See originating summons at HN10/372/Adams4. - See affidavit given by (i) at HN10/372/Adams5. - Brief contains short statements and accounts of the Wetherall and Downes mortgages (see HN10/372Adams2)'The court is to decide which funds or properties should bear the burden of the amounts secured by such mortgages'. - 'it is clear that the effect of the contracts for sale entered into by the testator or his authorised agent on the day before his death is to convert the lots 3,4,7,8 and 9 of Clipstone Farm into personally and therefore the 4490/10/- realised under such sales was personal estate at his death'. -'As the remainder of Clipstone Farm unsold was of a sufficient value to bear the whole of this mortgage the part converted ought not bear any part of the mortgage'. - If however, the above conventions are not accepted by the court Mrs Mann must be entitled to have the incumbrances on the entire estate so as to throw the proper proportions of the mortgages upon the real estate that was not sold by the testator'. - Brief shows accounts representing percentages of each mortgage apportioned rateably with the values of the parts of Clipstone Farm sold before and after the death of the testator.
