- TitleGreen & another versus Amsdon draft Statement of Facts - "fair copy sent Halse & Co Dec 30/87" - "In the beginning of the Year 1887 W.S.Green entered into negotiations for purchasing the Dunstable Brewery which Cutler & Hensman had placed in the hands of Alfred Thomas & Co. of 2 Adelaide Place, London Bridge for sale. Green in the first instance consulted a friend, a Mr.Fuller, a small brewer of Bedford, who recommended him to employ the Plaintiff [Edward Amsdon] to examine and report upon the property; - Mr.Fuller accordingly wrote to Amsdon and Amsdon replied to Fuller as follows (Copy Letter of 4th March 1887 [HN10/276/Green1]). This letter was forwarded by Fuller to Green & Green wrote direct to Amsdon as follows (Copy Letter of 7 Mch 1887 [HN10/276/Green2]); - Amsdon accordingly reported and it will be seen by his A/c that he gave an estimated Value of the loose Plant Rolling Stock &c in his reports; - Armed with this Report Green called upon Thomas & Co they asked 1800 for the loose Plant Rolling Stock &c and Thomas & Co agreed with Green to sell it to him for 1500 consequently no Valuation whatsoever was required but you will see by Amsdon's Bill inclosed [HN10/276/Green4] that he claims 28 in respect of it, namely 2 per cent on his estimate, he next claims on the strength of the Statement in the Letters to have a Commission on the Consumable Stock & Book Debts which he never valued nor was he asked to do so for the following reason. After the Contract for Purchase had been completed the question arose between Mr.Thomas & Green as to the Valuation of the Book debts Consumable Stock &c & Green mentioned that he proposed employing Mr.Amsdon and Thomas then said that he should refuse to meet him on the Ground that Amsdon had been recently a Clerk in his Office & had set up in opposition opening offices next door & that he had at that time an action against Amsdon for unlawfully detaining some Books & papers. Ultimately Green and Thomas arranged that Thomas should act for both parties in the valuation & that Mr.Thomas' Commission should be divided between Vendor & Pcher; - When Amsdon sent in his Account Green sent him, a cheque for 12/6/2 which was returned. Some Correspondence subsequently took place. Green died in October last and the Action is against his Executors; - The Total Amount of the Valuation for Book Debts & Consumable Stock was I believe 2356.
