- (ii) was seized of (a) and, on 29 May 1911 deposited the deeds with (i) having, acting a sguarantor, charged all his estate with repayment of a loan from (i) to Richard George Irving Byers, making (i) mortgagees of (a);
- in deed of 29 May 1911 (ii) appointed Frank William Howett, Country Manager of (i) and John William Buckhurst, Assistant Country Manager of (i) as his attorneys;
- (i) had demanded payment of the loan to Richard George Irving Byers and default had been made;
- (i) had offered (a) for sale by auction at George Hotel, Luton on 22 Jul 1912 at which sale (iii) was highest bidder at 525;
- (iii) had since agreed to sell (a) to (iv) for 525
