Scope and Content
The land subject of the abstract is as follows (inter alia). These are the abstracted parcel:(a) messuage or tenement and farmhouse at Holme with barns, stables, yards and outbuildings(b) several parcels of arable and pasture adjoining (a), all which formerly in the occupation of James Kingsley and afterwards of Henry Beauford(c) parcel of pasture land also at Holme called Gosling Close formerly in the occupation of Samuel Brunt and afterwards of HB(d) messuage or tenement with barn and stables belonging also at Holme with the orchard therewith formerly in the occupation of Thomas Fordham [...](e) piece of pasture land containing 13/1/5 being part of a field called Gallows Ditch heretofore containing 16/0/30 at HolmeThe abstract begins with the will of Robert Lindsell of Fairfield nr. Biggleswade (24 Sep 1856) devising the residue of his realty to his sons Robert Henry Lindsell and Charles Samuel Lindsell in fee as tenants in common. RL died on 30 Sep 1856 and his will was proved in P.C.C. on 17 Feb 1857.By a Deed dated 20 Nov 1857 the above land (inter alia) was conveyed from Francis George Lord Churchill, Charles Devon and Horatio Nelson Dudding to Henry Dalrymple Des Voeux, The Hon. and Rev. Augustus Duncombe and William Gray subject to the mortgage on the land (see recitals below). The deed recites a Mortgage dated 20 Nov 1844 from EL to the Rt. Hon. Francis Almaric Baron Churchill and Henry Raikes of the land (being of freehold and copyhold tenure) to secure 12000 and interest at 5% p.a. (3 10s.% p.a. given regular payment by specified dates). It also recites death of FALC (March 1845); deed of 30 July 1845, appointing Nathaniel Bridges as Mortgagee/releasee upon trust to reassign the principal and interest and to hold to the uses of FGLC, CD and HND; Transfer dated 31 Jul 1845 from NB to HR, FGLC, CD and HND of the principal and interest; Deed of 20 Nov 1849 between EL/RL (1) and FGLC/HR/CD/HND (2) altering the rate of interest to 4% p.a.A Memorandum dated 21 April 1858 on the 1857 deed records that the acting steward of the Manor of Biggleswade certified that none of the mortgaged lands were of copyhold tenure.In his will dated 12 Apr 1878 RHL devised to his eldest son Henry Martin Lindsell all his realty (including land purchased since the death of his father) in Biggleswade and Northill; and appointed CSL, HML and Arthur Knox Lindsell executors. RHL died on 15 Jul 1891 and his will was proved at Northampton D.P.R. on 23 Dec 1891.By a deed dated 26 April 1888 HND (as mortgagee) assigned and HDDV (also as mortgagee) released to Augustus Gerald Duncombe and R.S. Liddell the principal owing upon security of the 1844 Mortgage and interest; and conveyed the mortgaged land subject to equity of redemption. This deed recites that no assignment of the principal was contained in the 1857 deed but that the sum was vested in HND who had survived HR, FGLC (d. 24 Nov 1886) and CD; that AD died on 26 Jan 1880 and WG on 25 Sep 1880; and that the principal of 12000 and interest had become the property of AGD/RSL upon a joint account.By a deed dated 31 Aug 1903 AGD as Mortgagee assured and transferred the principal sum of 11450 and interest to Almeric William Fitzroy of The Priory Council Office, Whitehall, London, esq., and The Hon. Montagu Curzon of Garats Hay, Loughborough (Leics.), Col. on the retired list of H.M. Army; and granted the mortgaged land, acting as mortgagee, to the same. This deed recites that in 1901 550 of the principal was repaid to AGD/RSL; that RSL died on 16 Jun 1903; and that AWF/MC had become entitled to the principal and interest money.The abstract also records the death of MC (1 Sep 1907); the will of CSL (3 Apr 1901) appointing his sons Charles Thomas Lindsell of Holme Grove, Biggleswade and Lieu. Col. Robert Frederick Lindsell of the Glos. Regiment as trustees and executors; death of CSL (6 Oct 1909); and probate of his will at Northampton D.P.R. (18 Dec 1909).
