He also pointed out that the specification clauses contained in the Bills of Quantities for dayworks; Mr Humphreys asked for the following information: Are stanchion bases designed for Conder canopy?; When would the petrol tank be delivered?; When would the suction pipes and offset fill pipes be delivered?; Size of electricity ducts to draw chamber?; Where is temporary bench work?; What was to happen to existing vent pipes adjacent to building to be demolished?; In reply to a question from Mr Humphreys, Mr Bigmore pointed out the preliminaries and descriptions were the standard A.S.C. [Anglian Standing Conference] documents; Mr Bigmore asked for a copy of the programme chart. Mr Humphreys stated that it could not be completed until delivery dates for tanks had been established; Memo from County Architect to County Surveyor; 'Thank you for your memo of 24 Feb regarding the possible delay in obtaining the petrol tanks for the contract in connection with Waterlake Service Station. I am somewhat concerned at the position that I now find myself in and I think that we should have an urgent meeting, together with the County Secretary, to determine what the implications are to the County Council of delaying the works at this time'; Feb 1975 Letter from Bernard Ward (Bedford) Ltd to Architect's Department; 'We would inform you that delays are being experienced on the contract due to the late delivery of the petrol storage tanks. These are now on site and the delay in accordance with our programme of works amounts to about 4 1/2 weeks. We would also confirm that we intended to commence the tank excavation on 17 Mar and that you were to arrange for the tanks to be pressure tested prior to this date. Following a meeting on site on 14 Mar between your representative Messrs Pump Maintenance and our Mr Clayton it was apparent that the tanks would not be tested until 18 Mar at the earliest and on this basis we managed to cancel all plant for the excavation with the exception of the trench sheets which were delivered 13 Mar. We would inform you that we shall be submitting daywork sheets to cover the hire of these trench sheets until such time as the tank excavation can commence. We would also inform you that we shall be claiming extension to the contract period under Clause 23(h) of the Form of Contract when the actual period of delay is defined'; Mar 1975 Further letter; 'The excavation for the installation of the 2 petrol storage tanks commenced Wed 19 Mar. We would inform you that a 3'6" deep seam of sandstone rock was encountered at a depth of approximately 5' and a compressor was required to remove same. We look forward to receiving your Architects Instruction to cover our costs which were the hiring of a compressor, the additional hire for one day of a digger and 1 lorry due to the delay on the excavation and our own labour while involved in this operation'; Mar 1975 Architect's Instructions (1-14); Jan 1975 - Jun 1976 Letter from Bernard Ward [between AI's 5-6]; 'We confirm our telephone conversation with your Mr Tellam when the following rates were agreed for excavation bed etc., of safeticurbs: DBM Safeticurb (27) @ 10.26 yd; Silt Box (2) @ 14.84 each; Inspection Units (3) @ 12.52 each; These have now been ordered, delivery 7-10 days; We also record that the correct tank lids are still awaited, and have been since first found to be incorrect on 14 Mar, as you are aware, Pump Maintenance cannot commence work until they are on site. Prior to the contract being met we were informed by your Department that the tanks would be on site in Jan. I was informed yesterday by your Mr Maris that the owner of the garage is considering purchasing the tanks on behalf of the tenant and that it could be up to 7 weeks before they are delivered. As very little work can be carried out to the forecourt until the tanks and pipe runs are installed I am concerned about the financial aspects of extending the contract. Will you please let me have your instructions'; Feb 1975 Reply; 'If the Contractor is unable to continue his work without the supply of the tanks then I can only instruct you to suspend the contract until the tanks become available. I have written to the County Secretary to enquire whether or not any claim can be made against the tenant or owner of the property in respect of the additional cost that will be incurred as a result of this delay'; Feb 1975 Reply [further copy of memo near top of page]; 'I am somewhat concerned at the position that I now find myself in and I think that we should have an urgent meeting, together with the County Secretary, to determine what the implications are to the County Council of delaying the works at this time'; Feb 1975 Reply; 'I refer to your memo and subsequent discussions between Mr Holmes and Mr Bigmore regarding your consternation over the additional costs likely to be incurred in this Contract. As the cost of this work is to be found from funds allocated to the main Contract I can see no reason why any additional work that is necessary to complete the Service Station should not be included within your Contract, as it would have to be included in the road Contract if omitted. Funds for the complete road scheme will be allocated from the Transport Policy & Programme grant, which will include the cost of all compensation and accommodation works necessary for completion of the road construction. In particular, the surfacing of the forecourt should be taken to the boundary of the site, as set out by my Surveyor, even though this means additional costs to your Contract sum'; Mar 1975 Valuation No. 7 (final); Contractor - Bernard Ward (Bedford) Ltd; Value of work executed £14,399.76; amount outstanding £44.76; May 1977 Letter from County Architect to Bernard Ward (Bedford) Ltd; 'Thank you for your letter dated 6 Dec 1974 [not here] enclosing a copy of your Public Liability Insurance Policy. I would make the following observations: The Limitation Clause is unacceptable and should be omitted. The limit of indemnity must be £250,000. I would point out that the terms of the Standard Preliminaries makes you responsible for the loss or damage of all materials brought on to the site. The extension clause of the policy excludes such damage or loss and I would be glad to know if you have other cover for this. I note that in the exception clause liability for injury, loss or damage caused by any vehicle is excluded, but I assume that this is covered by the extension clause (vehicles). As there is a certain amount of demolitions involved in the works, I assume that these are being carried out by your own employees and would not therefore be excluded under the exclusions clause (Builders)'; Jan 1975 Reply; 'We are now able to deal with the points raised as follows: Limitation Clause: This has now been removed with effect from Mon 13 Jan 1975. Confirmation in writing from the Insurance Company is awaited; Loss or Damage to Materials etc: We have taken out a contractors "All Risks" Policy in respect of this contract with an "inclusion clause" for the items now not covered under 20c. This policy is effective from Mon 20 Jan 1975. Cover note is awaited; Vehicles: It is confirmed that your assumption is correct; Demolitions: It is confirmed that these will be carried out by our own employees; In addition to the above points we have obtained a verbal quotation of £100 premium in respect of Clause 19 (2) (a).
