Conveyance
Parties:
(i) Horace Edgar Bowles of Bleak Hall, Kensworth, Beds, gentleman.
(ii) Rural District Council of Luton.
(iii) Benjamin Hartop of Eaton Green, Stopsley, Beds, gentleman. (Chairman of (ii))
Reciting:
- (i) is seised in fee simple of (a-b) and desires is to be held by (ii) for the purpose of public walks or pleasure grounds for the inhabitants of Kensworth.
Operative:
(i) conveys (a-b) to (iii).
Property and land: (see attached plan)
(a) Parcel of land situate at Kensworth; bounded on N by public highway [common road]; E by public allotment gardens; S by Bleak Hall; W by strip of land 62 feet wide separating the piece of land hereby granted from an occupation way leading from the public highway to Bleak Hall.
(b) The building now standing on the land used for the purpose of a women's institute.
Habendum:
To the use of (ii) in fee simple subject to certain trusts and purposes
Covenants:
- Land coloured yellow on the plan to be held to the use that (i) will have the right of way.
- (ii) to ensure sufficient access between the building of the women's institute and Common Road.
- If (b) ceases to be used for this purpose the building should be substituted to be used as a village club.
- Whoever is in occupation of (b) has the responsibility to repair, maintain and even rebuild another building of substantial character to replace the existing building when/if necessary.
- (ii) has responsibility to support, maintain and improve (a) and provide sufficient fencing.
- (ii) must seek the permission of (i) before conveying (a-b) to Kensworth Parish Council or any other local authority which may succeed (ii).
- (ii) has the right to the production of the title deeds of (a-b) specified in the following schedule.
Schedule:
- Conveyance and covenant to surrender copyhold hereditaments dated 27th Jul 1887 between Thomas Jones and Elizabeth Gurney to William Henry Jones and Sophia Grace Jones.
- Mortgage dated 17th Sep 1910 between Constance Evelyn Miller (devisee under the will of William Henry Jones, deceased) to Aubrey Rumball
- Further charge on above mortgage dated 9th Jul 1912.
- Conveyance dated 1st May 1913 from Stanley William Bennett and others (personal representatives of Sophia Grace Jones) to Stanley William Bennett.
- Assent by Stanley William Bennett and Ralph Stuart Bond (executors of the will of William Henry Jones) to devise to Constance Evelyn Miller.
- Reconveyance dated 6th Nov 1917 between George Henry Edwards (executors of the will of Aubrey Rumball, deceased) to Evelyn Miller.
- Conveyance and covenant to surrender dated 8th Nov 1917 between Stanley William Bennett and Constance Evelyn Miller to (i).
