(Rec. of 20/68/2&3. Rec. Sir Wm. Robinson eldest s. of Sir
Tancred Robinson inherited estates on death of his father.
Sir Wm. Robinson married Dorothy Thornhill. Deed poll of 12 Oct.
1754 by terms of 20/68/2&3 Sir W.R apptd. manor of Clifton to
w. for life for jointure. Rec. of Act of Parl of 3 Geo. III for
abolishing right of average in ancient enclosures in Clifton
and enclosing Moor and Common. In pursuance of agreement of 1762
btwn. Sir Wm. Robinson & ten others, he to contribute 7-10s. for
every acre of which he was seized in Clifton and others likewise to
pay costs of Enclosure Agreement. Sir W. Robinson to retain 25 for
every ancient house and frontstead in Clifton, residue to be paid to
owners of ancient houses and frontsteads (25 each) in lieu of rights
of common and average. Tenants of ancient houses or frontsteads for
live only to receive 5, other 2/3 person(s) next intitled . Excrs.
of Sir William Robinson to recieve from persons next entitled 2/3 of
money laid out by Sir W.R. in exemption of ancient enclosures
from average etc. & for fencing and enclosing his allotments of moor &
common. 25 to be kept by Sir W.R for each ancient house & frontstead
of which he was seised to be divided in same way between him and person
entitled. After enclosure took effect Sir. W. Robinson received 1050
for 42 ancient houses and fronsteads. As well as this Sir W.R. paid
out 867-17 for exempting enclosures from average and for fencing and
enclosing. Excrs. therefore entitled to 2/3 of money expended with
interest at 4%. Sir W. Robinson d. March 1770 without issue, leaving
estate to w. Dame Dorothy. She died in March 1789 without receiving
any of the 2/3 of the money expended by her husband and interest was
in arrear. Her will dated 29 June 1780 in the 2nd. codicil apptd.
excrs. (See (i).) On her death Sir Norton Robinson became entitled.
He had no male issue. Thos. Robinson (3rd. and youngest s. of Sir
Tancred Robinson) & Wm. Robinson (brother of Sir Tancred) both dead and
left no male issue. Thos. Robinson (later Lord Grantham) died and left
Thos. Robinson his eldest s. (later Lord Grantham). He died and left his s.
(iv) an infant was first tenant-in tail of Clifton estate. Rec. of
Decree of Chancery of 20 July 1791 - Pltffs. were (i) & Defcts. Sir
Norton Robinson (a lunatic, guardian Hon. Fredk. Robinson.) Master to
take an account of money spent by Sir. W.R according to Act of Parl.
relating to Clifton Enclosure and money retained by him for ancient
houses and frontsteads. What 'should be coming on the said last
mentioned account' to be deducted out of money expended by Sir W.R.
Interest to be computed on balance at 4% from advancement of money to
death of Sir. W.R. This interest to be added to 2/3 of balance and
interest calculated from death of Dame D. Robinson to date of report.
Master's report of 25 April 1792 confirmed. Sir W.R. paid out 1917-17s
He retained 1050, balance therefore 867-17s. Interest to date of
report to be paid on 813-5-9. On death of Sir Norton Robinson intest-
ate, suit abated on plaintiffs brought a bill of revision. Sir Norton
Robinson's sister My. Robinson declined to take out Letters of Admin.
and limited administration for carrying on the suit was granted to
Robt. Rolleston. Then M. Robinson took out general letters of Admin. for
personal estate. Proceedings revived by Chancery Order of 15 November
1793. Order for taxing costs for Rolleston's limited admin., and rest of
parties to the suit. 81-10-9 of 813-5-9 paid, interest on redr. to
date of report to be computed. (iii) receiver of rents and profits of (i)
Ordered that (iii) should apply rents and profits to discharge of
principal and interest of 731-15s. (iii) for (iv) to pay all costs
except of limited admin. and M. Robinson 57-11s.. Costs of (iv) 219-13s
to be paid by (iii). Also to pay 731-15 and interest of 68-6s. i.e.
800-1s. in all.)
